Hi, Im new to this forum and need urgent help/advice. Our situation is quite complicated, so i'll try and keep it brief and clear. My auntie is a Pakistani national. She has 3 Children, 2 girls and 1 boy. Her husband is a British national and all the kids have British nationality. About 6 months ago her husband brought their 7 year old son to the UK. The mother was not happy about letting her son come to the UK without her, but was unable to stop the father taking her son. Now the boy is in the UK, and the mother is beside herself after finding out that her son was taken by social services on 2 occasions after the father had got himself drunk, and was incapable of looking after the son. Since the son has come to the UK the father has also been in prison and the son has been pulled from pillar to post. I have contacted social services on several occasions to see if we have any legal rights in bringing the son to live with us, but i have encountered alot of 'red tape' and have been told that the case is still being 'monitored'.

What i wanted to know is how we could apply for the mother to come to the UK to take her son? Her husband has always been unwilling to apply for a spouse visa and now her son is in a foreign country and facing an uncertain future.

All help/advice would be greatly appreciated. I have tried contacting the law centre in my area but they seem to be closed due to the bad weather, and if im honest im getting desperate and need to act fast to ensure the child is safe.

I don't think you have any right to insist that the child comes to live with you. However Social Services are normally very keen to place a child with family, rather than foster out with complete strangers.

Make it very clear to Social Services that you are there to assist, if the child does need to be removed from his father.

If she can't get a spouse visa she'll surely get a visitor visa, no? Isn't that sufficient to come here, prove she's the mother and get social services to hand over?
