Calculate time for permanent residence (ILR)

Post by sonut » Sun Dec 25, 2005 1:05 pm

I have been in UK for 4 years continuously -

6 months on work permit dependant visa (was working for 4 months out of the 6 months)

3.6 months on work permit (working)

Can I apply for permanent residence (ILR) ? Will the 6 months I was on work permit dependant visa be considered .

Is 4 years working period required or 4 years of work permit visa is required on the passport for getting an ILR ????

Thanks.

It took some hunting down but something akin to this has come up on this Board before. Take a look at this topic.

I think the OP summed it up. As confirmed by my fellow Moderator, Joseph, on 02.04.04 :-
Your 4-year ILR clock started when you switched to WP
So Sonut, it looks like you can apply for your ILR 28 days before your four years on WP is up.

1. Came to uk on work permit dependant visa - August 2001
2. Started work in November 2001
3. Received my work permit papers in November 2001
4. The work permit visa was stamped on passport in march 2002 due to delayed processing

When does my 4 year clock start for ILR (in Nov 2001 or March 2002)?

Thanks

Having looked at Annex F of the instructions IND give its staff, my opinion is that you can apply now especially if the "delayed processing" you mention was done to a delay at IND ...... but would very much welcome other opinions on the matter.
