Doubt regarding Earnings in Tier1(general)

Post by shy_sandeep » Sun Jan 10, 2010 9:27 pm

Hi,

I'm student doing 1yr Masters in UK. Before joining masters I was working in India for 2 yrs and my last salary was in Oct 2009. After I complete my MSc, (around Dec 2010) can I directly apply to Tier1(general) visa?

Website says "Earnings must be made up of 12 consecutive months and must fall within the 15 months before your application."
So if i apply in Dec 2010 and show earning of Oct-08 to Oct-09, would it be valid?

Whether only one of the salary should fall within 15mths or all 12 salaries?

Thanks,
Sandeep

Yes you can apply for Tier-1. All 12 months should within 15 months.

So there is no way one can shift from student to Tier 1 (general)?

Sorry I didn't made it clear. When you apply for Tier-1 you can use 12 consecutive months from 15 months immediate before you started studies. Make sense?

Ya totally.

So as I understand, I can show 12months earnings before I began studying? Like, 12months earnings -> 1 yr masters -> then applying tier1 general

Can you please point me to any document which clarifies this.. I could nowhere find info where your student time need not be counted.

Thanks a lot.

Sorry! There were few updateson Oct 2009 for the Tier 1 General guidance
In line with the Immigration Rules change the guidance has been amended to remove the provision for migrants in full time education to claim points for earnings obtained outside of the 15 months immediately prior to their application.
Mostly the students will not be able to claim the points before 15 months prior to their application

vks
