DEPENDANT visa TIER 1 - job, accommodation - URGENT help !!!

Post by collinsgem » Tue Jan 12, 2010 2:26 am

Hello,

I am holding a TIER 1 visa issued . applying tier 1 dependant visa for my wife. I went to UK for some months but found no job because of recession. Earlier I earned more than 45 K p.a.

- I have no job at the moment. But I have interview confirmation letter in the next 2 days, in one job I am in first waiting list (Letter proof)

- I shared accommodation, hence only my name appearing in bank statement is alone available not in tenancy agreement.

- But I maintained funds in my wife name for more than a year of around 10 lakhs consistently.

If I apply DEPENDANT TIER 1 VISA will it be successful.

so I am planning to submit,
- maintenance funds
- Previous employment letter
- Previous salary proof (40K)
- address (bank statement proof)
- my CV
- rest is marriage certificates (invitation, wife education certificate etc etc)

Please could you reply the earliest, i thank everyone for your help

Any reason for duplicate posts and the bold typeface?

As with any other application, dependent visa application will be successful only if the eligibility criteria are met and you can provide documentary evidence as prescribed to support the application. Otherwise not!

Read PBS Dependents - Policy Guidance carefully. The application form VAF10 and VAF10 Guidance Notes.

Unfortunately, no one can give you (or any other person) a "concrete" reply ... at least not in the way you want it to be (that you should go ahead and apply and you will be successful). We all can, at best, point in the right direction and provide advice or feedback based on (our) understanding of the rules and experiences.

1. Can you apply? - Yes.
2. Will you be successful? - Depends on how well you can explain in your application and convince the caseworker that being employed is not a mandatory requirement for main applicant when applying for PBS dependent and that necessary documentary evidence including that of maintenance funds (as presecribed) to support yourself and your dependent(s) in the UK is included in the application which fulfils the PBS dependent entry clearance eligibility criteria in all respects.
3. Will your previous attempt to find work in UK riase a red flag? Maybe ... or maybe not! Should you withold this information or be upfront about it? - Personal opinion and matter of integrity, so only you can decide.
4. Lack of accommodation proof - If you (main applicant) are in India and applying for PBS dependent, there is no need for accommodation proof. Evidence of maintenance funds is what is required to show that you can maintain yourself and any dependents.

Hope this helps.
