Absence of >90 days because of medical reasons...

Post by ConfusedIndian » Sat Jan 16, 2010 10:05 pm

I have been in the UK since Jan-05 and want to apply for ILR / PR. But I was out of the UK for about 6 months because of 2 surgeries, which were done in India, so that my family could take care of me.

While I was employed with the same employer(Tata Consultancy Services), I was not paid in the UK.

I was advised by one of my colleagues that I have a chance to get my ILR.
Is this possible?

Many thanks for all your advice.

Can you get letter from your company stating that you were in India and was sent to India for deputation by your company?

Hi, THanks for your reply...

I can get a letter from my company, but I was not paid my UK salary during that time. Will it still be considered?

Also, I was initially sent for a much shorter term, but due to medical complications, I had to undergo an operation and ended up staying in India for much longer and working UK hours from back in India as I was advised recovery time after the operation.

I was neither paid in UK nor did I pay NI for that time period.

Many thanks in advance.

Regards,
CI

Well as far as I am aware if you had valid visa during that period and prove that you were out of the UK for business reasons than you should get it.
