URGENTLY NEED ADVICE... NEED GUIDENCE

Post by mahmoodk » Wed Jan 13, 2010 8:58 pm

Please can someone help me with some advice? I've been to see now about 7 solicitors over the past 11 years, all they do is take my money (my nephews) and don't do anything.

I have been in UK since October 1998. I applied for political asylum within the time period of 6 months of being here. I have a nephew in UK whom is a Born British Citizen and I am the only family he has in UK. I have been living with him for total 11 years and 3 months and he has supported me for all that period of time. I have never worked here because I was never granted a work permit.

I have had several appeals but they were rejected and my last one was on human rights appeal from my nephew, which was 4 years ago and still now never heard anything back.

My question is? " A friend of mine told me, that he heard that after 11 or 14 years of being in UK on political asylum I can apply for naturalization and would be granted it" Is this True? Or is there any other way?

When can I apply for naturalization in UK as a political asylum seeker?

There is no such thing as "naturalisation as a political asylum".

Currently there is a long residence concession for illegal immigrants, which requires 14 years of unlawful stay in the UK to qualify for ILR.

However, we don't know if this concession will still exist in 1.5 years as the new law enacted last july abolishes ILR some time around July 2011. Even if this concession exists in some kind of form in 1.5 years it currently takes 2-3 years to make a decision on such type of application.

Furthermore current law on citizenship requires minimum period of lawful stay, which is at the moment 5 years. This would mean that you would need further 5-8 years of lawful stay to qualify for citizenship.

Basically it may take you 10+ years to naturalise.

You need to check if you qualify for ILR now under legacy.

It used to be a concession, but has been part of the Immigration Rules for a few years.

However I agree there is no guarantee that the 14-year path to ILR will still be around when the OP reaches the 14-year point.

14-year applications currently taking 1 to 2 years to be decided.

BLK235: thank you for reply to my post.

Thank for clarifying that there is no such thing as “naturalization as a political asylumâ€

U won't qualify for ILR until 14 years and then have to wait 2/3 years for a decision. Naturalisation would follow that.

U should deal with ur solicitor or sack her.

Wanderer: Thanks for your super lightening response:

But if they change the law in 2011? what will i be able to do?

Where it concerns my solicitor. I have had about 7 solicitors that only take my money and don"t do anything.

Can someone recommend a good solicitor in or around London area that knows my type of cases or has done cases like mine.... Its becoming a long and upsetting struggle now... with no light at the end of the tunnel.

Thank you

I don't feel any of us feel able to comment while u r under a solicitors guidance.

But, if the 14 yr rule goes, I guess ur only option is discresionary leave, if that exists as well! Why was ur asylum claim rejected, if it was rejected lawfully why don't you return to ur home country and apply for entry in some other capacity? What is ur home country and the basis of ur aylum claim?

as far as i know if you live in UK illegally for 14 yrs then u r able to apply for Indefinite Leave to Remain. and if you legally live for 10 yrs on any status (may be student, psw, visit or any) then u r able to apply for Indefinite Leave to Remain.

this rule is in implimentation at the present.

Kind Regards

I don't understand.
If you have had several applications rejected, what new evidence is going to change the HO result?

You seem to think that being here 14 years is going to be an automatic acceptance.
Why do you think this?

Also given the OP's somewhat wayward immigration history he might be under some sort of administrative removal anyway which would stop the 14 year clock.

Suggest OP requests his SAR file.
