Applying for British Citizenship now or later?

Post by m.mcgookin » Thu Jan 14, 2010 2:35 pm

Dear all,

Can you please give advice on my situation?

I have been in the UK for the last 11 years under legal stay (09/98-09/06 under student visas, 10/05-01/07 Science & engineering graduate scheme, 02/07-04/09 Spouse Visa, 07/09 - present ILR). I have been married to a UK citizen for the last 3 years (since 29/12/2006) and have satisfied the residency requirement (haven't been out the country for more than 90 days in the last three years, & etc).

I applied my ILR based on my marriage status (eventhough I was qualify to apply for ILR based on 10 yrs lawful stay, but the stamps in my passport weren't consistent to show that I have been in the country for those 10 years, and I didn't have posting receipts to show that my visa applications had been continuous).

I have been working full time for the last three years and I have all my P60s to prove my contribution to tax and National insurance. For some strange reasons, previously it usually took an average of 3 to 4 months to get my visas and also my ILR approved.

I am 3 months pregnant and would like to get my citizenship sorted or arranged in advance as I doubt I will be able to handle a new born and application during the summer this year.

I have only been on my ILR since 07/2009 and wondering whether I could apply for my naturalisation now or would I have a stronger application if I apply it in 07/2010 (one year into my ILR).

Any advices on my status are much appreciated.

Kind Regards,
mcgookin

You can apply NOW. That is as long as you were present in UK EXACTLY 3 years ago from the date that you apply.

You do not need to have ILR for a year when applying as spouse of UK citizen

Dear f2k,

Thanks for the advice, I will start getting ready all the paper works and form. I have been in the UK for the last 11 years, so hopefully the application will go through smoothly. I will be using the NCS services, hoping will make the approval procedure faster.

Any recommendation with the NCS service or should I just go for normal postal service (which I usually do as I have all my documentation).

Many thanks,
mcgookin
