Help finding out my status!!!!

Post by kenx65 » Tue Jan 19, 2010 2:27 pm

Hi,
I have just came across this forums and feel that it can be very helpful to me.
I came on a student visa in1998 and extended it in 2000. when my visa was about to expire in 2003, i came across a solicitor and he advised me that he can apply for ILR on behalf of me. That time i didnt have sufficient knowledge and i trusted him. After several months i got ILR stamp in my passport. I honestly believed he applied on the basis of staying in this country for that amount of time.
I been out of this country after getting ILR and no questions asked, came back, got NI number aswell. and its been around six years constantly, i havent been out of this country.
I have heard some news about home office corrupt employees, so i been recently worried and dont really know what to do!! I wanna apply for naturalisation but i am not entirely sure that i got correct ILR....

Please someone help me out and point me to the right direction.

So you had a student visa from 1998 until 2003? What is your ILR based on? Long residence as a student takes 10 years.
I tell it like it is.

I honestly don't know. This is something you should ask an OISC registered advisor or an immigration solicitor.
I tell it like it is.

Apply for a copy of your Home Office file under the Freedom of Information Act - see this page:-
http://www.ind.homeoffice.gov.uk/navigation/foi/

When you can see what's on your file, consult an Immigration Advisor or experienced Immigration Solicitor. If there is nothing on your file after the extension that you obtained as a student, then you have a big problem because it means that the ILR stamp in your passport is false, and you were just lucky that it was not noticed on the one occasion when you re-entered the country. If there is a record of your grant of ILR, then you have a better chance, but you should take the advice of a professional.
