Domestic worker visa refused

Post by ksreachme » Sun Jan 24, 2010 10:54 am

Hi,

I am writing on behalf of my relative who is trying to get a person from India on domestic worker visa. The employer (currently in UK) applied in Bangalore, India. The worker has been working with employer's sister in Bangalore and after seeing the dedication of the worker, the employer wanted to sponsor the worker on domestic worker visa.

Reason for rejection: Bank statement not containing wages paid to the worker.

Situation: The person has been paid in cash as it was difficult to open the bank account as the person was new to Bangalore and certain conditions were not met (such as worker does not have PAN needed for opening bank account). Prior to applying for domestic work visa, there were two cash deposits made to the person by the employer but HO is not accepting this.

The employer (who is already in UK for the last 10 years) is very keen to get the person to UK. Note that the worker is a distant relative of the employer (not sure if this needs to be highlighted in the application - this aspect was not at all mentioned in the application which was rejected)

Appreciate if someone can share similar experience and please suggest what other evidence can be shown in support of the application? Thanks in advance.

AIUI the worker has to have worked in the sponsors household for a year prior.

And the person would have to be the sponsors employee, not the employee of their relative.
