FLR expired while change of employment is in process

My Current Leave to Remain as well as Work Permit expired on last week but before that my new employer applied Work Permit application. Though my leave to remain got expired I was under impression that I should wait for new Work Permit decision to apply for my FLR.

Here is my question: now I am in confuse, should I apply for FLR without any further delay or should I wait for the Work Permit decision.

If I need to apply ASAP, what should I enter in FLR form question number 29, 38?

Or

If I can wait for Work Permit decision means how can I get the conformation that I am not in overstay (or breach of law).

Any advice or suggestion is much appreciated. (I guess if I could have got this doubt last week the story is different)
