Query abt my wife's Naturalisation

Post by mr_pankaj » Sat Dec 31, 2005 10:49 pm

Hello and New year wishes !

I and my wife got ILR last year after I completed 4 years on Work Permit BUT from the day we got ILR my wife had only completed one month in UK i.e. we got married and she joined me in UK in Feb 2005 after which we got ILR in March 2005

Now that we would be completing one year on ILR status, my query is :

Can my wife apply for Naturalisation along with me in April 2006, if No then when is the earliset when she becomes elligible to apply for Naturalisation.

thank you in advance for all your answers.

Pan, I think the answer is that she can apply in February 2008, after she has completed three years in the UK.

That is, you should go ahead and apply for your naturalisation in April 2006, assuming of course that you have already passed your Citizenship Test, or will do so by then. After your citizenship is granted your wife will be married to a British Citizen! Accordingly the qualifying time for her is reduced from five years down to three years.

When she applies she will need to pass the "in the UK exactly three years before IND receive her naturalisation application" test ... and as she came to the UK in February 2005 it appears she cannot possibly pass that test until some date in February 2008.

But Pan did she come to the UK at any time before February 2005? For any purpose whatsoever? If so please supply details .... the answer given above may change ... beneficially!

John - Thank you for making it clear.

My wife entered in UK for the 1st time on 13th March 2005 (and got her ILR along wiht me on 21st March 2005), so like you said I would take it the earliest she is elligible to apply for Naturalisation is after 21st March 2008 ......

Sorry, I am slightly confused as when is the earlist can she take the 'Life in UK' test ?

thanks again.

She can take that as soon as she is ready. The pass certificate does not expire ... but she should keep it in a safe place.

No, from 14.03.08 it will be clear that she will pass the "in the UK exactly three years before IND receive the naturalisation application" test.
