Ok I am trying to do all I can to get back overseas. I am Australian, my partner of nearly five years is British. My unmarried partner visa for the uk has just been rejected. We are now thinking of going to France and getting married on a schengen visa. Is that possible? I understand that we have to live there for forty days and from what I have read I can go there on the schengen visa, register at the marie and then get married to my british boyfriend and then stay. It seems a bit too easy though.
But I'm a bit confused as I have gone to France and stayed there for a lot longer than ninety days for the past two years and it didn't seem to matter. Or they just didn't check. Did it make a difference that I had a UK unmarried partner visa at the time? They just stamped me on arrival and departure... however this was in small airports and if I have to go straight to France from Australia I will have to fly to Nice.
If I don't have a UK visa anymore will it be harder to get in? Is that where I need to apply for the visa beforehand? If I happened to lose my passport and get a new one would that be a better idea? I desperately want to be there in the beginning of March - I know I most probably won't make it then, but I really want to get there as close to that date as possible. We have a friend who lives there and will state that we are living with him.
I hope this made sense... I am looking at any option possible at the moment.
