EEA REFUSAL

can some one tell me what to do next.
My brother applied for me under the EEA LAW(dependant) to the u.k immigration.The y wrote and wanted my passport, but unfortunatly my passport was lost and is being reissued by my countrys embassy.
The wrote back to me refusing my application.
My questions are.
1.Am i still legal in this country?
2.When i get my passport back from my embassy ,can i still send it back to them?
3.what is the best thing to do in this situation?
Some one please tell me as this is way too confusing for me.

So... allow me to simplyfy..

1. You sent an application without a passport and thus no proof of nationality or leave to remain

2. You're asking why you got refused?

3. We can only tell you if your legal in this country if we know your nationality, visa status and a little bit more history.

If the post is anything to go by, no wonder it was refused! Did you really expect anything else, without sending your PASSPORT?
Smart thing would have been to wait until the new passport was issued, then send it off with the application.
Only you can say whether you are legal or not, right now! Were you, before you 'lost' your passport?

On what visa are u in the UK now, and on what grounds are you dependent on your brother?

Thx for the quick response.I did come in on a visa,then the EEA application was made.It took them about a year to ask for the passport,and when they did it was already been reissued by my embassy.So had it been it was requested for at the time of the application, and sure it would have been made avalaible to them.
At this time, i jst want to know if i should made another application and between now and when i get the passport,what wil be my status.
