I need your urgent help... Sponsor's license

Post by markaliva » Fri Feb 05, 2010 11:50 am

Hello,

I would really appreciate your help on a serious matter. My company has applied to get a Sponsor's license. However, that application is still being processed and my leave to remain ends in a week.
Without a certificate of sponsorship, I cannot make an application to extend my leave to remain. What do I then have to do??

If you take section 3c of the Immigration Act 1971, it mentions that "To prevent applicants from becoming overstayers through no fault of their own, section 118 of the Nationality, Immigration and Asylum
Act 2002 introduced an amended section 3C into the Immigration Act 1971.Section 3C automatically extends the leave of a person who has made an application for further leave to remain during a period of extant leave. Technically, the leave is "treated as continuing"."

Clearly, in this case, it is not my fault that the application for a Sponsor's license is taking long. Without this however, I cannot make my application. Would I therefore be able to send in the application without the certificate number, and attach a letter saying that the sponsor is still trying to get the license? Should I overstay?

Has anybody gone through something similar? What should I do? Please help!

Thank you very much,

Mark.

1. The first thing is that u can not blame HO for not making a decision on u employer's licence as that was your employer responsiblity to make sure that they hav read the guidence regading the time lines from HO.
2. It was also u responsiblity to sort all that out well before u visa is expired and not wen 1 week is left.
3. U r on about SECTION 3C of the immigration act, it would not apply to you as u do not hav the essential requirements to apply for the visa.
4. If you apply now then u application will be refused or shall i say invalid and u wud not have a right of appeal in any case.
5. The only option is to (Tier 1 General if u have enough points or switch bak to student visa).
6. If you can not score any points for the above visas then leave the UK and apply from your home country as any stay after u visa expired will be classifies as an overstayer.
