i have a question regarding my friend. he wants to marry a eu national girl. and they applied for certificate of approval from HO in january. the visa of my friend is expiring in april. ny question is that in some cases the HO takes a very long time in granting of approval. so if that delays and the visa ranout so what will be the satuation wether he will be overstayer.
advice will be much apriciated

The COA is not a visa, so if his visa expires in the process he will be an overstayer.

Let me guess, ur friend is an Asian Student with an expiring visa has suddenly met a Latvian/Lithuanian/Estonian girl and they truly, truly love each other and are totally absorbed in each others language and culture?

He can, if he can prove that the relationship is genuine, the 'EU girl' is exercising her treaty rights in some way, and that their 'relationship' has subsisted for at least two years!

My guess: Tier 1 (PSW) visa that's expiring soon and the individual cannot switch to Tier 1 (General) because no masters degree or MBA topup won't be complete before PSW visa expires!
Getting married comes up as No. 1 option (or the only option) if one wishes to remain in UK!
This said, there's nothing wrong in taking this route if the relationship is genuine and not an excuse to stay in the UK!

no he is on student visa he want to go to her girl friend country for marrage to avoid COA from HO and will apply for his RC from uk. will he be fine?

Your initial question mentioned he applied for a COA in January. Now you say he wants to avoid it?
