hi, there i need advise on what to do about my present immigration situation
i was arrested by the UKBA, some few months ago for overstaying my visa for for months due to the fact that i lost my passport and i cant bear the fact of living my wife and child alone, and i have been given temporary admission to stayed and report at a reporting centre every 2weeks.....can someone help me with some few advise on what i can do to regularised y stay here in the uk.

Why can't you return to your home country and apply properly from there? Hint; not wanting to isn't a good answer!

i was advise by the immgration officer to get a lawyer, and that i can apply form here instead. also, i have paid the home office fee and over 10months now i have been waiting and signing at the reporting centre, but i am getting tired of waiting.....but my lawyer gives me hope abt an article 8 of the human right act.....i am so confused.......help

Well there those who laud HRA Art 8 as a panacea to cure all immigration woes but as u experiencing it isn't always so.

If your home country is not dangerous why not bite the bullet, return and apply from there? If you've never used any deception you won't be refused.

you have already wasted 10 months waiting for your application to be processed and you have been given no set date in the future.
Your quickest option in my opinion is to go home if possible and apply from there.
Be aware that the hope given to you by your lawyer may be false hope and article 8 is not a sure win option

Not an excuse to overstay!
You could have got a new passport/emergency travel document from your embassy, if you were serious!
You say you can't bear to leave your wife and child alone, but that is a consequence you will have to bear if you want to sort yourself out as soon as possible!
ie. Go back to your home country and apply properly from there, instead of hanging on to some 'maybe' art 8 option, which could drag on for yonks!

The OP has replied by PM, so I should not divulge the amount - while it is not a fortune, it's certainly a significant amount for people who may not be earning very much.

I asked the question because I have long believed that a very large number of professional immigration advisors/solicitors tell the punter what he wants to hear, rather than the objective chances of a successful application, because there's no money in it for them to tell the prospective client that his case has no merit.

This may well be the case with the OP, so he's now in limbo until UKBA make a decision, which will probably be a refusal. Then his solicitor will ask him for a further sum to present an appeal......

People who go to solicitors or immigration advisors should get a "client care" letter spelling out exactly what they have been told and what is expected, and read it very carefully before they hand over any money.

an advise from me: you need a lots of patience when it comes to the home office, people on this board have been waiting for longer. patience is a virtue. good luck

My best advice from my own experience:

If its safe to return to your home country then I suggest to get the necessary passport/emergency certificate from your countries embassy/high commission, gather all the evidence for applying spouse visa (If you are married to a british citizen or EEA citizen) and leave the country in next flight without wasting time. Waiting for Home office to respond to your application is complete waste of time as far as I know. so the best way to move forward is to apply from overseas. Although its difficult and scary, you really don't have any options. Good luck

Search this forum - there are plenty of people who wrote about their experiences. From what I've seen - it is not easy and takes a lot of time.
