EEA4 PR Complicated case

Hi Hope someone could help mein this:

I am non EEA and living in UK from past 5 years and 4 months I am on EEA family permit which going to expire end of this year. I have applied for Permanent EEA4 and got papers back becuase my wife never work in past 5 years. She was pregnant when we move to UK and my son is 5 year old now, he born in UK after 2 months when moved in UK. I never thought that she suppose to work 12 months to exercise treaty of right. I was thinking it would be same becauce I am working continueosly from last 5 years without any break instead of her. Because she could look after our little one.

I am so confused what do I do now are they gonna give me another 5 year family permit extension instead of PR. So it means do I have to wait for another 5 years to get PR? Please someone advise me in this.

Your wife needs to have held comprehensive sickness insurance cover for the three of you, for the duration of residence in the UK where she has been self-sufficient (you have been working).

Did / does she hold his insurance cover?

Look at AXA or other insurance companies. It's impossible to backdate, you have to start from scratch.

And starting from scratch means: amassing another 5 years of residency in the UK with CSI (if your EEA national remains self-sufficient) before you both automatically qualify for PR (around 2015).

If your partner has like a European Medical Insurance card, and you can show evidence she is receiving support from you, which makes her self-sufficient, then you will be fine.

Assuming your child is in UK school aswell, the time he or she has spend in education, will count towards your residency, in any event.

Yes my son is in school started last year.

Unfortunately she has not got any insurance neither me, what if I would get International Comprehensive insurance from Asia for past 5 years?...

As seeing others comment above do I have to stay another 5 years to get PR?..so HO would provide another 5 years extension to me?.... My 5 year Family permit get expire on oct this year... ..How about if my wife get start work from next month for coming 12 months and then after 12 months I or we could try again for PR in 2011. MAR/April?

EEA regulations required If you are a national of Bulgaria, the Czech Republic, Estonia, Hungary, Latvia, Lithuania, Poland, Romania, Slovakia or Slovenia, you cannot apply for a registration certificate/PR until you have completed 12 months' continuous employment in the UK.
