Very Strange Scenario! Plz Help

Post by wadihawi » Sun Feb 21, 2010 9:20 am

Hello everyone,

I was a student in the UK and graduated less than a year ago on July 2009. I left the UK in august 2009 and My student visa expired on November 2009. I applied for an international company in jordan which has a branch in the UK and was offered an introduction to the job at the UK branch as I am a UK graduate. I applied for a business visa and was introduced to the job in january 2010. After a successful introduction I was offered a temporary job at the UK branch as a one year training (placement) in the UK.

will I be able to apply for a post study work permit? I satisfy all other requirements - (recognized engineering degree, maintenace..etc)

My student visa has expired but I am currently on a business visa for 6 months until june, does this satisfy the requirement for entry clearance?
will this affect my PSW application?

What is advised best to be done in this scenario?

Help is highly appreciated.

Many Thanks

read this page carefully. i believe you can only make out of country application. you are the best person to judge this though.

here is the link

http://www.ukba.homeoffice.gov.uk/worki ... l/#header2

i have pasted two paras which i think is relevant.

good day

how to apply if you are outside the United Kingdom

The process for applying if you are outside the United Kingdom is:

Step 1: complete a self-assessment online using our points-based calculator to find out if you are likely to score enough points.
Step 2: go to the visa services website, which you can find on the right of this page, to find out if you must submit any personal details in the country you are applying from and to find the application form.
Step 3: take or send your form(s), fee and supporting evidence to the visa application centre. You must also arrange to give your biometrics, which are usually taken at the visa application centre.

We strongly advise you to bring all supporting documents with your application. We will not consider any evidence provided after we have made a decision.

If you are granted entry clearance as a post-study worker from outside of the United Kingdom, you will be able to live and work in the United Kingdom for a maximum period of two years. When the end of this period approaches you will not be able to extend your stay, as we expect you to switch into another category of the points-based system.

The immigration categories from which you can switch into the post-study worker category

If you are in the United Kingdom and wish to remain as a post-study worker, you will need to be sure that you can switch into this category. You can apply to extend your stay in this category if you are already in the United Kingdom as a student (which includes students, student nurses, students resitting examinations and students writing up a thesis).

Switching into this category is allowed if you currently hold leave in the following categories:

* student;
* student nurse;
* student resitting examinations;
* student writing up a thesis.

Thank you so much for your responses. I forgot to mention that I am currently outside the UK and will be applying from outside the united kingdom. Would that be OK regarding the above scenario?

Many Thanks I really appreciate your help

in that case, you satisfy all the requirements of psw, but keep in mind that HO may decide to curtail/cancel your business visa after issuing you psw. So make sure that psw is indeed the right visa for your needs.. think about next 2 years and not just 10, 12 months.

if you move into tier 1 or tier 2 category then this time will be counted towards permanent residency whearas psw doesnt count. So, again its up to you to choose best visa for your needs.

Good luck
