Is it possible to get a british citizenship after divorce?

Post by 4uvak80 » Tue Mar 02, 2010 11:07 am

Hi everybody. Could anyone help me in this situation? I am non-EU national married to EU national, but now relationships are about to brake. Divorce is possible. Are any chances for me to get British citizenship after I divorce my husband? We have been married for 2.5 years now. Please help! Thanks!

What's your current visa status in the UK?

In your situation you should worry about getting Permanent Residence (PR). After spending 1 year on PR you can then apply for BC.

Do a search on Retention of Residence Rights to get more details on how you can get PR in case of divorce. I don't think you qualify for that right now.

In a nutshell you need to have been married for 3 years before divorce proceedings initiated and to have lived for at least 1 year with your husband in the UK. You will also need cooperation of your husband when applying.

Thanks for your reply. We are not divorcing right now. Do you know what will happened if we divorce after 3 years? Thanks for your help. I will check Retention of Residence Rights.

I guess if you get divorce from husband than it will be difficult to get PR after expiry of your current visa.

No. Divorce is quite a formal process and you would definitely have to be notified if your husband was bringing divorce proceedings.

Where is your husband now? If he's left/leaving the country you have to too.
