hi

i've been reading plenty on this forum and elsewhere regarding the need for a schengen visa for spouses of UK citizens with an ILR.

I am a British citizen and am married to an Indian citizen who now has an indefinite leave to remain in the UK (ILR). However, the ILR page does not show anything regarding the face that she is married to me.

Am i right in thinking that i can quote/show Directive 2004/38/EC and my marriage certificate to the immigration officer when i land in France or Italy (still deciding on the holiday!) that they can't refuse us entry when travelling together?

any help/advice appreciated!

Please use the search - this comes up a lot. Basically the IO's are the easiest to convince - it's the airline thats the difficulty - they are liable to fines for carrying passengers without the correct visa and err on the side of caution.

The OP could try to convince the airline to contact the IOs on the destination side... If they are ok the airline may be off the hook.

With Eurostar the French immigration control would be already in the UK though I never heard if that worked out for anyone.
