spouse of irish citizen

Post by jimalmodovarn » Sun Mar 07, 2010 8:01 am

Good day, I just want to ask and this is the situation: my wife got her citizenship certificate September 2009 and i have applied for my own naturalisation January 2009 and had renewed my working visa last month and got 5 years, since I being a spouse of Irish Citizen and parent of IBC my questions are:  :P
1. should i re-apply for naturalisation on the basis of being a spouse of irish citizen (when i submit my application my wife hasn't got her citizenship)
2.where and how could i get an 4EUFam card and how much it will cost me. ( we are planning to go to UK this april)

Many thanks.. :)

1. No. You've been in the queue for little over a year already. You'll only lose more time if you change the basis of your application. I wouldn't recommend this.

2. You're not eligible for an 4EUFam card. This is only available to the spouses and dependents of non-Irish EU nationals who are exercising their treaty rights in Ireland or (b)Irish nationals who are returning to Ireland after a period spent working, studying or being otherwise self-sufficient in another EU country.

Your spouse has been naturalised as an Irish citizen; she is therefore not exercising her EU treaty rights simply by virtue of residing in Ireland.

first off, don't make another application on basis of marriage, no need. in order to avail of this, i think you might need to reside in ireland with wife/irish wife as an irish national for at least one year!!! this is not the case here. simply write to the dept to update them on additional information with copy of her passport and remind them of child's citizenship, this will help you as your link with ireland has strenghtened. no point causing dept delaying further, as you have already meet the criteria on your own account.

two, don't expect to get citizenship if you leave ireland permanently/for space of 2-8 months whilst your application is in process!!!!!! One condition, which you signed on a declaration form, was that you would in good faith continue to reside in ireland. if the dept caught wind of this, you can be sure they may give you problems. citizenship is not collect 20 crisp tokens and you will get your prize. within one year, the dept WILL be seeking further evidence of continued residence and self sufficiency ie payslips for past 3 months, p60, bank statements and copy of new gnib card!!!!

There have been several instances in the past(1990-1997ish) where eg non irish doctors were refused citizenship as there was evidence that they leave ireland after getting citizenship and avail of additional bonus of eu citizenship, thus making citizenship a bit of a joke.the fact that a declaration was signed won't help if promise is breached

so if you plan on travelling, make sure you keep yor base here for most of the period - keep tracks covered.once you get citizenship then you are free to do what you want i guess

three, unless you and your partner had citizenship of another eu state, you and your partner don't fall within the eu fam stamp whilst in ireland.you both fall within domestic irish law

Four all matters relating to travel to britian, falls under british law so contact the british embassy in case you need a visa, despite your wife being able to travel with you under eu law. will you need a re-entry visa to come back to ireland?,(despite eu law)
