Long Residence - Long Gap school didn't apply on behalf

Post by k333 » Thu Mar 04, 2010 8:13 pm

Hi everyone, thanks for ur replies in advance!

I'm applying for 10 year long residence visa, all on student visa.

however one of my gaps is:

March 2001 (when I was 15)
My school boarding school had my passport and was meant to extend my leave, but they didn't
My visa expired on 31st March 2001
went home see my family for the summer (abroad), left UK 29th June 2001 {overstayed}
then
came back to the UK with a fresh visa starting 23rd August 2001

What do u think of my case? and how do you think my case can be argued? if no at all?
any opinion would be grateful!!!

x

In my view your new visa clock would start from 23th August 2001...So from this time you need to complete 10 years which is 23 august 2010 with only allowed gaps.

I belive your previous stay gone in air. :shock:

But I always advise to seek profession good legal advise before doing anything

For 10year stay you have to have 10years of continuous lawful stay. Your stay covers a period of unlawful stay as well as a period outside the country with no leave to remain. Your clock therefore started in August 2001. assuming you meet the requirements the earliest you can apply is August 2011
