Business Permission/ Green Card

Hi All,

I am new to this site. I have found information on this site very informative.

I have been living in Ireland for close on 10 years and awaiting naturalization and long term residency application status to be approved. Not all my time was legal in Ireland, in hindsight, what I know now would have helped many years ago.

I am currently on a Green Card Work Permit which is due to expire in June which will then mean I receive a 'Temporary Stamp 4' for one year.

I am looking to set up a business with a few EU partners, I would like to know if anyone has been in a similar situation given I am 3 months away from not requiring work permits etc.

I know I do not need business permission from the Minister for Justice as I will have EU directors but how does this impact my legality if I have a company set up now, will I be able to receive a work permit for the 3 months duration or am I best off waiting for the temporary residence before commencing with the business venture?

Thanks, and much appreciate some advice if anyone has been in a similar situation.

Whats the story I thought Green Card Holders will instead be given stamp 4 at their next renewal stage? (Pointless making their renewal subject to being able to get a new permit, which is not in guarantee despite years here) Temporary means if you loose job, tough. So unless that happens, you should be able to renew the stamp 4 no problem (considering you still have employment/business, family here etc)

Do nothing until you get your stamp 4. once you get it, it would be a cold day in hell that you won't get it renewed again. stay cool, hopefully you would have long term resdiency by then. Business permit applications will take a while, by time you have a decision, you will probably have LTR, or that stamp 4 after renewal of permit. also, so much hassle making application as its strict (300,000 euro rule) As you know, the only resistrictions you will have as a stamp 4 holder getting involved in business is just the COmpany and tax laws (same as everyone else) and immigrations laws when trying to employ non eu citizens who need work permits

The company set up now, don't panic say nothing (after all it takes months before you are allowed to trade and practice etc), and don't get invlolved till you have the stamp 4 in your pocket

Thanks for the info walrusgumble. I guess that is the best approach.

You are correct in saying Green Card Holders will be given stamp 4 at their next renewal stage but only for '1 year temporary residence' provided you can submit 3 months payslips upon renewal. This is to do with the Immigration Bill 2008 which has not been implemented yet.

I spoke to an immigration lawyer today and was informed that if I wait until temporary residence (June) then I 'should' be able to continue in the business venture and provided I stay out of trouble I 'should' not be rejected upon renewal of temporary residence. Hopefully by then my naturalization and long term residency applications would be processed by then! The lawyer said immigration law is very vague in Ireland.

In relation to Business permission - if you have EU partners as directors then the Non EEA is not required to have €300 000.

The lawyer is correct. WHen the stamp 4 comes, then ypu can publically work in the business (naturally the set up of business takes more than 3 months etc). Best of luck with it,

Ye, you would want to be a total idiot to loose the chance to renew. Whilst the success of the business might be out of your hands in todays climate (at least you could do a course) you will hardly want to get into trouble (be it for tax offences, road traffic or worse) as it may effect any potential citizenship. SO long as you comply with the stamp 4 critieria, the Minister would have EXTREMELY difficult taks in removing you should he wished too. (it would not be in his interest)
