Penalty points

Post by haylz » Thu Mar 11, 2010 8:38 pm

Hi

I was wondering if someone could help with this please.

Me and my hubby live in Northern Ireland and my hubby applied for naturalisation about 16months ago. We got a letter saying that we have to send a criminal reference check. My hubby got penalty points (3) and a fine last year for going through a red light and got a fine for overtaking in the wrong lane at the same time.
Will this mean automatic refusal for him for his naturlisation as it says both these on his criminal ref check or can he still be granted naturalisation?

Thanks
Hayley

The best and worse people in the world will get penalty points. If you paid the fine on time AND DID NOT GO BEFORE THE COURT (thus no criminal offence) then, sit down, calm down and go to the chippy, you should be ok. Seeing you had no offences (assumingly) before making the application, you might despite (a) minister's discretion and (b) Judges reluctance to interfere, you might have a good fight if you were to challenge it in court.

i don't believe the points will go on the system, unless a summons is made, delivered and appeared before a judge (the summons)

Look, you should be ok, but be good and be smart (and stay in school)

i think u if u had paid the fine on time and no court case is carried out, there is no criminal offense. i would say move on with ur application and be very much careful from now on.
