Please Help - Ex Foreign National Prisoner in UK

I am a Zimbabwean national.

My passport got stolen in 2003 before my visa expired (in 2004).

Zimbabwean Embassy refuses to issue another passport as I do not have any form of I.D.

I applied to extended my visa 7 months later it had expired in 2004 (that application is still waiting further until to date 2010).

I could not work with no I.D, I was under pressure to provide to my family and was homeless. I was not entitled to any benefits or anything.

I got involved with the wrong crew and helped them to launder some money.

I got done for it and received 3 years prison sentence.

I am now out, living with my family (my partner and 2 kids - all are British born citizens). I have been with my partner for 5 years.

I also have another child from my ex (all are British born citizens).

I am scared I would get deported to Zimbabwe when deportations resume.

I dont want to be seperated from my family.

Could someone please advice.

As for the offence I committed, previous to that, throughout the years I have complained several times to the immigration complaints unit and my MP that I required my case to be dealt with quicker as I was under pressure to support my family.

I am not a career criminal, I was put in that situation and I am glad I got arrested before I turned into something I am not.

Did the judge recommend you for deportation when you were sentenced?
What papers have been served on you by UKBA? Did they serve a "Notice of Intention to Deport" you? If so, have you appealed? Or were you served with an IS151A as an overstayer, leading to administrative removal? The latter is a less serious consequence than a Deportation Order, and removal may be easier to avoid.
I guess they haven't gone as far as serving a Deportation Order on you, which is the normal result of a prison sentence of that length. What action is taken when the policy on removals changes may depend on many factors at the time. In the meantime you can only sit and wait. The longer it takes, the less likely removal will be enforced.

I hope you're paying child support to your ex....

Yes, the sentencing Judge recommended a deportation.

However, during serving my prison sentence, I challenged the Prison and Home Office decision not to send me to an open Prison.

I won the case in High Court, were the judge said that I was not a danger to the public nor a person without family ties.

I applied for Aslyum (Feb 2009) and Human Rights whilst in prison, so when I received an intention to deport, it wasn't relevant with my asylum pending.

I have only had a screening interview. I have been stressing the UKBA for my official interview.

Around 2005 I was under pressure to provide to my current family and my daughter (from my ex). I ex was refusing me to see my daughter if I wasnt financially supporting her. I notified UKBA of my situation, and ask them for documents to permit me to work. They never replied but they have letters in my file as I have a copy of the file.

Currently, my ex wont allow me to even speak to my daughter on the phone cause i am not financially supporting her - I am on immigration bail and aint allowed to work.

I am scared to be separated from my family and my child from previous relationship.

What should i do?

I am not a danger to the public, I deeply regret my foolish decision to get involved with the wrong people.

Please help. I already suffer of stress and depression and I feel like killing myself. I really love all my children and fiance. I cant be seperated from them

I really appreciate your help.

I fully know your forecast of events doesn't mean that is how it will happen.

I would really appreciate some advice and your forecast of what is likely to happen to me, thus, will I be seperated from my fiance and children who are all British born ctizens and have lived all their lives in UK.

I last lived in Zimbabwe in 1995, all my relatives have fleed Zimbabwe, nor do I have any friends in Zimbabwe. Here, my in-laws have become my family and my children are attached to them and their cousins

I am really worried and anxious. I am depending on anti-depressants to help me out.
