Home Office Queue system

Post by Nazz » Wed Feb 01, 2006 5:37 pm

I have applied for long residence concession 14 years an still waiting( 1 year)

I do have a question is that how the Home office's queue system works?

Is it like the normal queue where each application is assigned a number?

If that is the case then how come some people get the ILR faster than others i have heard of waiting times of 1 year while others have waited for 3 years plus and still are waiting,it simply doesn't make sense if there is a queue system.

How many case workers are there in HO to deal with Long residence applications?

Thank you for your patience

Naz, I would recoment you to go an speak to your MP. Tell him that you have been waiting for a year now and make sure you give him your Home Office reference number. This will speed up the process. Cheers.

Nazz, why did you not apply for your ILR in person? I know it's more expensive but it's better than waiting over a year.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

It is not possible to make a 14-year application in person at a PEO .... such applications must be made by post.

Aaaah, ok, that's unfortunate.

Could it be anything to do with the HO making checks about your presence in the UK in the last 14 yrs?...
Is this a plain 14 yrs legal stay?... eg student etc?... or is this based on an asylum application?... as this would increase the chances of more checks to be made.

If all of the stay is totally legal it is not necessary to wait until 14 years. It would be possible to make a 10-year application.

So the fact that a 14-year application has been made suggests that for at least part of the 14 years there was a period of being an illegal.

John, just for interest's sake, is there a sort of gentleman's agreement on the part of the home office that they won't arrest you and deport you if you come forward after 14 years and claim your ILR? I assume that even after 14 years of combined legal/illegal stay they still have the discretion to deny your ILR and arrest you and deport you?

Dawie, my understanding is that the UK has signed up to an EU convention, and subject to what follows, not to deport people after they have been in the UK at least 10 years.

There is no compulsion under that convention for countries to offer ILR or permanent residence but the UK chooses to allow people to apply for ILR, in order to regularise their situation.

The exception? If the person staying here is detrimental to the Public Good .... the person is found to be a terrorist or the like, then the UK reserves the right to deport irrespective of how long the person has been here.

Pretty strange! Usually if a MP writes to the IND they comes back with a respond within 14 days plus, they also speeds up things.
