Benefits and visas and bringing my Egyptian Husband to UK.

Hi all.
Need alot of advice.
I am married almost 3 years to my Husband and have also lived for 2 years in Egypt.
I have lost 2 babies tragically in Egypt, and in June 2009 i returned to the UK to find work and a home to bring my husband to. Unfortunatly i couldn't find work and after 3 months went back for a 5 day visit as i was to start a job the following week later.
In this time i was back in Egypt i got pregnant and i am due to give birth on the 6th of June 2010.
I have recently recived a house from the council, and i am soon getting income support, which i don't want to as i have always been a worker
and have tried all the pregnancy to find work. Now i have no choice as no one will employ me now.
I have been to CAB and been to a solicitor which deals with legal aid and Immigration, they told me it was not possible till i hads secured a home and had a job, but i need My husband to join me for the birth of our child, WE have no savings at all and i have no one who can help me sponsor him as the plan was for me to do it, but its all on hold now.
I seem to have done all i can, we have a genuine marriage, also in the church, we have been together for 4 years and had tragedy as well.
What can i do?? I want him and need him with me, to help me, with baby, i am totally alone in Newcastle upon tyne with no help, family and no one and feel terrible to know i can't have the one person i need with me.
It will take months for me to get settled with baby, and find a job and get off benefits, Is there anything i can do to get a family visit, visa, spouse or any kind of visa, I have only 11 weeks before baby should be here.

He is graduated from law University in Egypt and he is excempted from the military, he is willing to work at anything, and has no crimminal record.

I just have to find a way to bring him to UK before baby arrives, and i haven't got money to loose iff he is refussed.


PLease anyone can help with advice, as i am at my wits end as to what to do now.

Unfortunately you are in an invidious position here, until you establish yourself you are going to find it impossible to secure a spouse visa I feel. Also there is no way a visit visa will be granted with a wife in the UK...

If you want to risk it and try for the spouse visa basically you need to be able to show you are a family will have 156 pounds a week left after all essential bills, ie rent, power etc.

This is not really possible on benefits - the benefit system is geared to supporting the claimants, not one extra.

It would look good if he had a job offer but realistically in this climate no-one is gonna do that for a stranger with a time-limited visa.

Sorry but I can't think of an easy way out of this one yet.

In 2008 I went to the CAB and told them about my situation and was told by their experts that as I had no job and I was on income support there was no way that the UKBA would issue a spousal visa but my wife has been here 18 months and has recently got her ILR so don't let anybody tell you you have no chance.
Bear in mind that every case is decided on its own merits but in my opinion since you have accommodation and can support your husband while he is here and you are entitled to benefits then you should get your husband to apply for a spousal visa.
The Home Office is not inhumane and they are there to help genuine applicants.
You say you have 10 weeks before the birth of your baby so get your finger out and start preparation for a spousal visa

PS I am still on income support

pps The amount of income support I received was £64.30 and my wife was issued Spousal visa without any problems

Thank you very much for your advice,can you please tell me how i can start the process, how did u do this? and how long did it take?
Iam now with my husband in Egypt just for a visit and iam going back next week to UK so i want to start it direct but i dont know where can i start that?and what kind of document should i take with me?

If you do not have the finances for a spousal visa you can apply to the DWP for a loan which they will take out of your income support on a weekly basis.
There must be other organisations who are willing to give you money or loan you money.
Charities for example or an organisation who deal with pregnant women, there are many philanthropic organisations who have lots of money to give away.
You can always try the Church for help.

Have a look here but if I remember rightly it can take up to 12 weeks but it can take as little as a few days as evidenced by other spousal visa applicants in this forum if you are prepared to do a little searching

Your advice has been very helpfull,i just wonder what do u mean by the british embassy?the one here in egypt or where i live in newcastle?

Iam just reading on the site u just gave me but we still have the same issue

these are the rules:
You must show that:

1* you are legally married to each other or have registered a civil partnership;
2* you are going to live together permanently as man and wife, or as civil partners;
3* you have met each other;
4* you can support yourselves and any dependants without help from public funds;
5* you have adequate accommodation where you and your dependants can live without help from public funds; and
6* you are aged 21 or over.

and we still have the problem with point number 4 and 5!!

I also wondering what is the home Office and how this can help us?

If you are in Egypt then you can go to the British embassy in Cairo or Alexandria.
Your husband is the one applying so it must be done outside the UK.

as I previously stated if you are British you are entitled to public funds, it is your husband who will not be entitled to public funds and this will be stamped in his passport'' no recourse to public funds''.
To all intents and purposes the UK government will classify you as single with regards to public funds

So 4 and 5 really mean additional public funds so you have to survive on the public funds you are entitled to now.This means you have to support your husband but he can apply for work as soon as he enters the UK.

One bright light is that you can apply for benefits for your child when it is born

HI KEEP us all updated on your progress as i am in a simaler position with no funds and just about to marry my egyptian man. i have been going back and forth for over two years now and plan to get wed in june then i want him with me in the uk i did have savings from a previous marraige which i have used going back and forth and want him back in the uk with me to start a new life together so let me know what happens :)
