WP holder getting married to illegal entrant

Post by Marie B » Fri Feb 03, 2006 6:09 pm

An aquaintance of mine is in this country on a work permit. She originally came to the UK on a WHV and then got a WP, I think her WP is valid for 4 years starting in 2005.

She is planning on marrying this year. Her fiance arrived in this country 'clandestinely' three years ago and never made his presence known to the authorities. I think he has bought a fake passport and obtained a NINO. They are planning on flying back to his country of origin and marrying and then applying for him to be dependent on her work permit.

I'm sure I have read in the past that a WP dependent visa relies on the dependent not having a dodgy immigration history. He will no doubt get rid of the fake passport, etc. and get help returning home (IOM), will they have to state on the application where and how they met?

I'm not a close friend of the girl but friends of mine are, they say she's in love with this guy but are worried she'll end up ruining her own immigration record. I think friends of his have given her bad advice. What do you think?

Marie, do you know what the intention is? That is, the dependent visa will be applied for in his country ... and honestly completed? Or if not, what will be the explanation as to how they met?

I ask those questions because if there are any untruths on the VAF1 application form, and those are discovered, that would clearly be a rather big mark on her immigration record.

The advice must be ... tell the truth! (Not that I was suggesting they would do anything different.)
