appeals process advice needed

Dear Sir/Madam

Thank you for your email. We received your Notice of Appeal on 15 February 2010. A review will be conducted and, if upheld, the Notice of Appeal will be forwarded to the Asylum & Immigration Tribunal as soon as possible. If we overturn the decision at review, you will be contacted with arrangements to submit your passport. This process can take up to 3 months.

In order to help us to provide a good service to all our customers you may not receive a reply to any further enquiries about the progress of your appeal.

this is what i received from abu dhabi few days ago and if any one knows why they take 3 months to review the decision i send my appeal to abudhabi thinking it wil be quicker as mentioned on there website because it sys there they will send the appeal bundle within 8 weeks and now they are saying it will be 3 months any comments will be welcomed

The civil service is always backlogged and your claim goes into the queue which will take months to process.
You do not go to the top of the queue unless you pay the new fee of £15000

Following Parliamentary approval, the new immigration fees announced on 20 January and 10 February 2010 will be introduced from Tuesday 6 April 2010 for all those applying to study, visit, work in or stay in the UK.

The new fees are set out in the table that you can find on the right side of this page. Also on Tuesday 6 April 2010, we are revising a number of our application forms. If you are submitting an application on or after 6 April, please:

thanks for all ur advice but my question is still not answered i wanted to know how long does the uk visa ppl take to review a decision b4 they forward it t ait uk and ive read the website of ait but can any one tell me how long it really takes please would be very helpfull

In simple words

Review within 2 months time(Normally 5 weeks) but in your case I see no chance at review so focus on appeal.

Hearing would be in minim six moths time.

The point I was trying to make is that the process is the same for all unless you pay the £15000 but this is for people who are celebrities/famous/rich/connected.
Everybody else has to wait in the queue!

well 15000 pounds too much for me
ive received an email from abu dhabi saying that it can take up to 3 months for my review of my appeal and than forwarded to ait uk so that got my nickers in the twist that why soo long

The premium service is for in-country applications, though.

And it's for a "same-day" decision on applications. I can't see how it would apply to appeals.

The question of £15000 is irrelevant, there are no fees for hearing appeals that I am aware of.
The standard acknowledgement says "up to 3 months" probably in case the local ECM has to refer some matter of law or policy back to the UK and wait for a reply. In the vast majority of cases this would not be necessary, and I can't imagine that it should take the ECM more than a week or two to look through the papers and satisfy himself that the refusal decision is sound. As implied by another poster, I wouldn't hold out too much hope of a change of decision locally unless you can show that some aspect of your case has been misunderstood, or that there's some key piece of evidence that has since come to light or was originally missed.
Also, taken literally, the three months also includes the time taken to get back in touch with the applicant and get him to submit his passport if there is a change of decision.

really appreciate ur help n comments well i understand mr rusty i dont think it will be over turned becaz i dint send much evidence with that but will be faxing allot once they have received my appeal in ait uk hope they do accept that after the appeal is logged and again many thanks for all ur help

i hope u come bak here to read this
as i said earlier that i dont think they will turn th decision but its been 6 weeks now my appeal is lying with the uk visa ppl and i have been told that my case will be article 8 of echr case so dont know if it means anything to visa ppl or not but hopefully should win it on appeal i hope so thanks any guidance will be very helpful thanks

afather what was the basis of your original application? Why do you think that it is now an Article 8 matter?

got a daughter in uk she is 6 years of age n i had my court proceeding in uk the court hearing was due on the 5th of jan 2010 but my visa got rejected i am divorced from the mother and obviously she dont want me near my daughter so have to go through court have appealed n just curious if u have any info plzz do let me know

It looks like you were applying as a person with the right of access to a child resident in the UK. Is that right?

What happened in the court proceedings in Jan? Do you have a residence or contact order yet?

What was the reason for refusal given in your refusal notice?

Have you had or maintained contact with your child in the past?

no i applied a s a visit visa n no havent got a contact order and yes was in contact with my daughter ...my court case was dismissed becaz i was not there n now have to apply again for another contact order proceedings
my application was rejected under 320 7a because i dint mention my traffic offences so got rejected but had full rights of appeal so have appealed now
what do u think have i got any chance in winning the appeal

There are two groups here , one is a supporters group and the other is a ''snowballs chance in hell'' group

You are looking at a long wait so don't get your hopes up of a quick resolution of your case

afather, in the absence of any Article 8 etc. etc. claims how long are you technically "banned" for under 320(7B)? 12 months? 10 years?

If you can get a court order for access to your child, then 320(7B) shouldn't prevent an application on that basis, but it is going to be very hard to get a visit visa on appeal.

Can you instruct representation in the UK so that you can at least get the court process moving? I don't know anything about custody laws, I'm afraid.
