HSMP dependent Work

HSMP dependent Work

Hello Friends,

I am passive member on this board, and this forum is excellent. Kayalami, Chess, Cosmopol..all you are amaging and the members too.

I applied for HSMP on Feb 28th and my case number is 139** (Scored 110 points).So, expecting the letter around first week of June.

I need your advice in my case.

I am currently working as Technical Manager in India with a good pay and my wife is a Software Engineer. If my HSMP process goes well as planned we both are planing to work in UK

Now I have some second thoughts after looking into some of the postings and members experience "after reaching UK on HSMP".

Is it better to resign this job and try my luck in UK? or take leave for 30 to 45 days and if not succeed come back to India and try from here.

As it is easy to get employment at entry level Software Engineer position, Can my spouse continue working in UK(Even if I am in India?)

Hope you understand my case. So, my queiries are

After getting the HSMP approval and entering into UK, howlong we are permitted to stay outside the country(UK)?.

If the job demands to move in and out of the country on business, how it will work out?

Will the spouse get the WorkPermit dependent Visa? Can s/he continue working in UK in the absense of HSMP visa holder?

If there is something that I am missing, please fill those gaps too and advice me.

The choice is ultimatley yours but IMHO you will not get a job in 45 days unless you have organised this beforehand.

No it is not easy to get employment at entry level positions - the IT market is saturated and entry level posts are AFAIK on the outsourcing train. However your wife is allowed to work in the UK without needing a work permit and can do so during the validity of her HSMP dependent visa irrespective of your presence or otherwise in the UK.

The HSMP requires a signed undertaking (do you remember that part of the form?) that you will make the UK your main home. The UK Home Office at the time of HSMP renewal take into consideration absences form the UK for employment reasons on behalf of your UK employer and/or UK based self employment e.g conferences, training workshops etc. Lengthy absences from the UK as you describe where you are working abroad for a foreign based company will result in your HSMP extension application failing due to a lack of 'economic activity' in the UK - it is your economic activity as the principle applicant that is considered not your spouse's. No HSMP renewal for you = No HSMP dependent renewal for your wife = you must both leave the UK. Nice try but the HSMP Team knew this would be a loophole and they shut it pretty tight 8) .

Yes Puti, Kaya is 100% right.

a. Very difficult to get a job in 45 days, unless luck is with you. You should keep a room of 2-4 months for getting the first job.

b. Manager level posts, which really requires UK experience and employers are more attached to UK PMs having skillset of Prince II methodologies.

c. IT/Telecom developers/architects are having hi-demand (truly experienced,hi-skilled,hard-core), if you are ready to prove your hands-on expertise (not managerial).. you will get job.

d.Other option for you is try through Indian companies having offices/development centers in UK, they may prefer you because you are eligible to work in UK. eg. MBT, TCS

e.If your spouse is holding high-demanded skillsets, you can make a try through your spouse. But you have make sure that your HSMP extension have solid support after one year.

Finally, if you are ready to takeup any job till you get the first break.. then you are welcome.

As you sound like a risk averse person, the best (and most secured) way is to be sent here via an Indian company as timefactor told you.

Your information is indeed very helpful. Thanks a lot. I am in my current position after working as Developer and Solutions Architect. The only thing is I must prepare to move one or two steps back in my career(Its okay, I prepared for that)..

And my wife is not exactly at the entry level, but have 3 years experience in IT.
May be we have to study the current IT market trend (or get some insider analysis) and move ahead.

Anyway, after receiving the Letter it may take another 2 to 3 weeks to get the EC. I am yet to get the complete information to apply for EC and don't know the turn around time (in India). Anybody have idea on this?

AFAIK, same day processing [My spouse got the visa stamped on same day, from chennai, british embassy]

Dear all,
Is there any procedure for the HSMP dependent to get independent migrant status once in UK or does one have to stay as dependent for a lifetime ?

The person should apply for their own visa in a relevant category e.g. HSMP which if approved supercedes the dependent category. If the person is a visa national i.e. from a country whose nationals need a visa to enter the UK for any reason even as a visitor then approval of the 'switch' by the Home Office would be on a discretionary basis.
