Citizenship -dependents who are more than 350 days out of UK

Hi All,

I would to like to ask a query regarding the citizenship application (along with main applicant) for dependents (wife and kids).

My wife and kids are out of UK more than 350 days from last 6 years. Currently I am in UK. I am planning to apply for citizenship soon within few weeks when my dependants come back to UK.

My question is:

1. Is there any problem being 350 days out of UK from last 6 years? Due to personal work they went to home country and 270 days continuous absence within 2009-2010. Can my wife and kids eligible for applying citizenship along with my application as I am main applicant. My dependants are also having ILR status.

Please clarify.

Why are you talking about the last 6 years? Can you now tell us how many days they were out of the UK in the last 5 years?

Also, how many days out of the UK in the last one year?

In last 5 years they were total 350 days out of UK. In the last year 270 days out of UK.

Could you please clarify, absence of days (example 350 days or more) out of UK will be applicable for minors (i.e. kids) while applying for citizenship?

How old are the children? That is, when you hope to make the Citizenship applications for the children, how old will they be?

When I am planning to apply for citizenship for my children, they will be 7 years and 11 years.

The main problem will be for your wife, who will have been out of the UK much more than 90 days in the last year. So for her there is no way she will succeed in getting Naturalised as British. She needs to wait until in the last year, up to the date of application, she has been out of the UK less than 90 days.

You applying for Naturalisation? Your children applying for Registration? Not a problem.

But you might want to delay all the applications, including yours, until your wife's day count is OK ..... a wait of about 6 months, from when she gets back to the UK?

I would like to clarify one query with respect to days out of UK (for myself as main applicant) in the last year. So far I am 88 days out of UK in the last year as of today. As of my employer business work, I am going to out of UK only for 4 or 5 days within next few weeks (before applying citizenship). So with this my out of UK days count will increase to 92 or 93 days in the last year.

Can I produce a letter from my employer about the business work to count those 4 or 5 days as business trip? Please suggest is there any other option to make those 4 or 5 days business trip travel days won't come under the count of 90 days of last year.

I read in one of the forum topic, that upto 100 days absence out of UK will consider if applicant provide any genuine reason to support this. (like any employer business trip etc). Is this correct? Please clarify.

According to UKBA site, absence of up to 100 days in the final year will be ok. In the following link, read the section under "Absences during the final year" for more information

I feel that simple 49 can apply for naturalisation for himself earlier?? and dependent can apply separately when their 5 year is completed if they like to do so, As in my case I will complete 5 years earlier than my dependends. In this case now it makes me a doubt. Can I apply separately instead of waiting for dependents but it will cost more . Any advice please
