Overstayed but will be coming back as EU-citizen

Post by leon.fosters » Wed Mar 24, 2010 3:17 pm

I'm non-EU citizen and overstayed my UK visa for 5 months. I know I must be banned from coming back to UK for a year. Meanwhile my circumstances changed and I will be issued with EU passport and for this purpose I have to leave the UK.

Will my current status as an overstayer affect my right to come back to the UK in a short term (less than a year) with valid EU passport?

There is no EU passport, please tell us more and post a timeline.

Originally I leave in Estonia, was legally on visa in UK from July till November 2009. I don't posess estonian nationality but eligible to apply for it. So I'll be passing my language and citizenship test. And therefore will be getting estonian nationality if I pass.

It's not quickly. I've been living there permanently since 2005. But last year I had to come to UK, overstayed, and now have to go back not to lose my entitlement to gain nationality.

If you acquire full Estonian citizenship and passport (not just Estonian Aliens passport), then you will have free rights of movement throughout the EU, including the UK.
