He will have to return home and apply for a spouse visa there - the overstay wont count against him unless he used deception or false passport etc.

No way of avoiding that.

The CoA may be a mistake, remember it's not a visa and confers no valid leave, and used by UKBA to pinpoint the whereabouts of an overstayer for removal. It's happened to plenty, wedding day arrests....

Even if u got past that hurdle ur then husband will still have to make a spouse visa application from home.

I suggest he returns home - forget the CoA, marry in Algeria and apply from there.

CoA is aimed at people WITH valid leave, originally it was just another UK HO money making scheme - it used to cost Â£300. Now that's been ruled as unlawful so I feel and others too that the UKBA use it pinpoint an overstayers whereabouts, one more for the removal counts, we are doing a good job etc....

U can watch UK Border Force on Youtube for real Wedding Day arrests...

Really there is no method for an overstayer to marry here - and why should there be really - the only way is leave UK ASAP and hope you don't get removed first and then do things properly.

If you have a solicitor you should speak with him/her but I find people here know more than most legal eagles, sad but true but here's free!

the UKBA aren`t stupid and don`t have enough resources to wast them.
they do choose who to target on reliable data and investigations ,true there has been wedding day arrests, but those i know of and not by watching some scaremongging tv program and being my self an ex overstayer so i have a large circle of aquintances of the same sort ,every single one of them was a real sham marriage.
i just got back from wales where i was a ring bearer for a friend of mine who`s in the same situation as your husband his wife is a student and because they were together for 4 years (they truely are solmates)and everything went as planned without a glitch.
they had to wait for a bout 8 months for their COA to go through ,also for the single reason that the wife is a british citizen ,he will have to go to algeria and get his spouse visa,it`s a formality really ,however ,waiting times vary from a customer to another, this means he could be there 2 weeks or 6 months ,but, if all the documents are ok only death could seperat you.
could luck ,and you will only find out if you try.

This shows how misled some people are.

I will agree that getting his spousal visa is a formality though but overstayers and their loved ones find it difficult to believe and I understand where they are coming from, the thought of seperation and the uncertainty is numbing

don`t quite get what you mean by mislead .i think you need to know that if you`re sitting in your comfy chair and dispensing some (knowledge ) based on air think again better wait 8 months and work and save money for a rainy day which i don`t think you`d get .
its a begginning for regularisation and coming back to the open world if the rule says do it then good luck to you,but at least let peolpe with the experience talk and support those in need of advice .again there too many people here trying to judge people without knowing any facts of their lives and do not let others help by undermining them .
getting married here rather than going back to their home countries has got a reason i know and they know obviousely you do not so be a good boy and be quiet.

Many immigrants who are here illegally are really wonderful people and I do hope that things work out for you but we are only trying to open your eyes to what could happen and advise you what would be the BEST option.
We are not allowed to give advice on how to circumvent the immigration rules as per terms and conditions of this forum
If you partner got involved with the police for whatever reason good or bad and his immigration status discovered then he would be deported.
Any long term goals would be easier if he follows the approved route.
I understand that being 4 months pregnant you want your partner to be with you but until he gets permission to stay every day he is at risk of being discovered.
Anyway from what you have said he sounds like a good man and I hope you will be very happy together

Another thing if I was doing something illegal I would never come to a public web site to ask for advice as authorities may check to find that a home computer was being used and use this to start an investigation.
If you use a computer in a library or internet cafe you may be ok but to use your computer at home is also risky.
Also with authorities taking anonymous calls regarding crime and immigration you have no idea of what is happening until the dreaded knock on the door is heard
