Can I get a job while waiting for a visa hearing?

Post by tyronegal » Thu Apr 01, 2010 4:28 am

Hi everyone,

Just wanted to find out more information about my current situation. I'm a full time student, about to graduate in three months. Currently my passport is with the aslyum tribunal ( i dont know what their full name is). Reason: My mother of whom I am a dependant of had applied for the post study visa, I think it's the tier 1 visa. She completed her Masters last year and had been offered a phD position at her university. The Home Office however looked at the application and rejected it the first time because they claimed for the past six months she's been in the country, she hasn't had enough funds in her account as required. She passed all the other points though, so she appealed because that was simply not true. Her bank statements say otherwise. We had a first hearing in February and then there is another one of which we are not sure when because they haven't informed us yet. All I know is that each one of us got an individual letter saying that they have our passports e.t.c and out case is pending and that we should not leave the country e.t.c. My question is, since I don't have any form of ID with me right now, if I want to apply for jobs after graduating in June, will employers accept me if I showed them this letter? I'm really concerned about this because I wouldn't want to graduate and just stay at home doing nothing. With the option of a job even if eventually they reject the application all together atleast I will have some kind of savings to make a move somewhere else. I'll appreciate any information on this issue.

Seems to me you do have the right to take employment, because if you had this right as her dependant, she made an in-time application, and the case is now under appeal, your conditions are preserved until the case is concluded.
However, whether an employer will bother to satisfy himself that you are so entitled is another matter. You can only apply and hope that the employer will consult the helpline and that a correct answer is given.
