Your best chance is to go back to India and apply from there.As you rightly said you need COA before you can marry here if you are not EU or british national.Do not waste your time chasing lawyers who may even compund your problems.Why did you abort that baby, you missed the opportunity to sort your issue if you have a baby or your prospective wife is pregnant.

To the OP: bear in mind that applying for a COA while you are illegal in the UK could alert the authorities to your overstay and enforcement action taken against you. I do not mean to be pessimistic but the number of documented India + eastern European sham marriages does not work in your favour either.

Risk applying for a COA in-country or return home and sort things out? Your choice.

Plum70 you have misintepretated the point I am trying to raise.If this guy intends to marry this lady what evidence the authorities need than a baby. The best evidence in any relationship are children. Well I am not aware about the well documented sham marriages between Indians and eastern europeans. Please remember people come to this forum to look for solutions to their problems but not unfounded allegations or media headlines about immigrants. I welcome constructive criticisms but those coming from prophets of doom.

what u need to do is marry with her in ur own religious way, like in temple or mosque, take pictures as evidence that marriage actually take place , take marriage certiificate from temple or mosque as prove and send it to home office with coa application , they will definately give u COA

Jay-Khan as the law stands, this guy can either marry in church of England without COA or get COA from HO and marry in registry. He can marry in temple and get all the evidence but I do not think HO will accept that for immigration purposes

Hello jay khan and trouble ( sorry coz that what is ur id is and I don't know ur name) thanks for the advice I really appericate that.

I was thinking befor about marring at church of england and did some enquiry on it. The person at church told me that to marry at church ( coz I am not from eu) they have to apply for a licence. He also told me that even after getting married at church they have to send the information to the registrar and if the person is illigal that marrige is not considered as genuine. That person really confused me.

As you told about temple and then apply for coa. Will the home office consider it ? If you have some knowledge about that coz you said befor " u know it happen twice" can you plz tell me how they did it .

Listen my friend you cannot just go to church of England and get marry there you have to be an active member, i mean real member not just for the sake of immigration. We go to church in order to have a personal relationship with God , whatever comes with it is just a bonus. If your intention is to go there to get marry then you are following a wrong course of action. As I said earlier if you think your marriage is geniune then go back home and get marry. Take a bold decision and go home to get marry there.All the best.

Hi sachinsahil, as advised by the members on the forum, your best bet is to go back to India, get married there and apply for a Resident card from India (that is if you Mrs has a WRS- regiseteration, she should be exercising her rights in UK- studying working or self sufficient)...

At the moment your history is not the best and mind you any one who does see this will think there is something fishy going on...I am not pointing fingers or saying its a sham marriage but if I can smell something not sounding right then the HO will surely investigate this further.

If you really love her and want to be with her do the sensible thing for youyrself and her. otherwise you might be inviting trouble mate.
