ILR enquiry - possible with gaps?

Hi

I have a 9 months gap in 4 year period (for business reason - employer sent offshore). Should I submit ILR application in person or I should better do it thru a lawyer? Can you suggest any good lawfirm who helps in this matter?

That is 'DIY' territory if you have all documentary evidence and meet the residence rules!

Which PEO will be better for personal application? Birmigham or Croydon?

It doesn't matter. just make sure you have all documents.....


I know of a student who wromgly thought that his case would be looked at favourably by going to Glasgow PEO rather than Liverpool or Birmigham - but unfortunately he was proved wrong!!!

I think you'll find the Birmingham PEO a little less busy because its a smaller office, but thats about it!

Exactly what documents are required? I think a letter from employer explaing the gap is a must. But my employer (an Indian IT firm) is not willing to issue such letter. Is it mandatory that the letter must be from HR department? Can my manager (technical) issue it on company letterhead?

abcd1, you do not disclose your location ... which is your right ..... but you should go to your nearest PEO.

However, if for example you are halfway between Birmingham and Croydon then I agree with bbdivo, you should certainly choose to go to the Birmingham PEO. Well it is in Solihull actually, a few miles east of Birmingham City Centre.

We went there in March 2002 to get ILRs for my wife and step-daughter, but then you would not expect us to go anywhere else, given that PEO is only about 20 minutes drive from where we live.

I don't think that there is any requirement that the letter be issued by HR, your Manager's signature should be fine.

I recently got ILR with considerable absences due to job reason. Apart from one the rest were under two months at a time (though commulative time away was large). I would advice you to take all your pay slips and p60's along with you. I was asked for all my pay slips and p60's and after having a glance at them ILR was approved.

Is the PR60 form mandatory? My employer doesn't provide such forms.

If you mean the form P60 then yes, it is mandatory for the employer to issue one of those to their employees still employed at the end of the tax year on 5th April.

If anyone leaves during the tax year they should be given a P45 instead.

If those forms are mandatory - how can my employer not issue it to us? They have over 1000 employees in UK and nobody gets those forms!

They are mandatory! Are we talking about the correct form :-

Form P60

-: or possibly an approved substitute of that.

You are saying that there are over 1000 employees in the UK and no one gets a P60? I am amazed! It is a requirement for such forms to be handed to employees still in employment on 5th April no later than 31st May. Most employers will issue them with the payslip say at the end of May, or even the end of April.

The rules are mentioned on this HMRC webpage.

The legislation is in Regulation 67 of the Income Tax (Pay as you Earn) Regulations 2003.
