Dual Citizen - How to Fill Out Form AN

Post by newyorker123 » Tue Apr 13, 2010 9:15 pm

I had a couple of questions:

1. My spouse is a dual US / EU citizen who received an Indefinite Leave to Remain endorsement in her US passport after she spent 5yrs here as my work permit dependent. When I applied for Indefinite Leave on the family's behalf, I did not mention her EU citizenship in the application, so as not to complicate things (since she first entered the UK as a US-citizen dependent of a work permit holder). If she now applies for British Citizenship, does she (or should she) need to include mention of her EU citizenship in Form AN?

2. On a couple of occasions, my spouse entered the UK with her EU passport, so there is no entry stamp recording her entry dates to the UK. If she does not mention her EU passport in form AN, does she need to prove her dates of residence in the UK to fulfil the residence requirements to obtain British citizenship?

Dual Citizen - How to Fill Out Form AN

She did not have a physical EU passport when she first moved here, and she got ILR in her US passport so that there would be no question that she satisfied the 5YR rule for citizenship when it came to applying. We were told by one lawyer that the Home Office could potentially consider her in the UK as a EU citizen exercising treaty rights from the first day she obtained her physical EU passport (which was several years after she first arrived here as a work permit dependent), which would have added several more years to the citizenship process.

No, not at all. A passport is merely a travel document.

So does she need to (or should she) include mention of her EU citizenship in Form AN if I did not mention it in the group/family ILR application?

If she only includes/lists her US passport/citizenship, does she still need to present additional proof of her residence in the UK given there are a few missing entry stamps into the UK when she used her EU passport instead of US passport?

I would just stick to US citizen.

On departures/Arrivals she doesnt have to provide additional information but just to include them with other absences. That shouldnt be an issue cause u dont always get an immigration stamp when coming into UK
