Question on job ends before your permission to stay runs out

Post by lichung » Sun Apr 18, 2010 11:48 pm

I am a Tier 2 (General) work permit holder, the expiry date of my visa is Jun 2011 but my contract is ending this summer.

1) Does my employer has the responsibility to inform Home Office about my job ends before the expiry date of my visa?

2) It says on the Home Office website that they MAY limit my permission to stay to 60days - that means I can stay for another 60 days after the end of my contract right? What exactly will they do and how they are going to inform me?

3) Say if they limit my permission to stay to 60 days can I undertake a part-time job that is at the same professional level as the job on my CoS during that 60 days?

absolutely... if they dont and Home Office finds out, then they might penalise your employer in some way. and ultimately, you might suffer in one way or another

HO probably will notify you via your employer OR maybe its implicit that you have to leave country after 60 days even if they dont explicitly send you a letter. Check rules for further details and keep in mind that ignorance is not bliss when it comes to immigration matters...

You are treading on grey area here. Legally, 60 days are for you to pack your stuff and go home, not get employed anywhere else. Remeber part time work that you are allowed to do is only while you are on a tier 2 which you will not be when HO is notified. On the other hand, if you can make an arrangement such that you are paid cash then its all fine but why would any employer give you a part time work based on tier 2 visa??? Especially, if p/t employer decided to check your status directly with HO? think...
