Help - ex Prisoner

I am an ex-Prisoner and CCD are dealing with my case.

I was sentenced to 3years 3 months in prison for fraud charges.

I was released in October 2009 via the Asylum Tribunal otherwise, the UKBA - CCD had issued an IS91 to keep me in custody and claimed it was not bleaching any of my human rights.

I am a Zimbabwean national, I have been in UK since 2002, never been in trouble before my conviction.

My passport got stolen in 2003, and I appeared in crown court as a witness when the person who stole it got caught.

My visa - working holiday makers expired in 2004 however sent in an FLRO application as I can not get another passport from the Zimbabwean Authorities without any proof of I.D.

mY FLRO application is still waiting further consideration and in 2008 whilst in prison I applied for asylum - should be interviewed in the next few days.

I have 3 children - 1 from a previous relationship and 2 with my current partner (whom I have been with and lived with for 5 years).

My children and partner are all British citizens and am scared to loose them if I am deported.

I am really scared of my parent's relatives who want to kill me because of been bi-sexual.

I was sent to South Africa by a church - to foster parents because I had been tortured by my parents relatives. UKBA doesnt oppose that I am a Zimbabwe - but I last lived there n 1995 - I was 13 years old - besides the letter from the church - I do not know how to proove my ccase.

Can someone help on this case.

Could you please also advise on whats likely to happen to my case.

Having received a sentence of that length, the UKBA will almost certainly seek a Deportation Order against you. However, until your asylum claim is decided, they will not do so. If your asylum claim is refused, you will have a right of appeal. Under "one-stop" procedures, any other Human Rights issues such as your claim to a family life in the UK must be submitted for consideration with your asylum claim.

But I'm sure you have a legal advisor who has explained all this to you. No-one here can tell you truthfully whether you have a "good claim" or not. It is disingenuous to suggest that you couldn't muster the evidence of identity to obtain another passport if you had wanted to; even without birth certificates etc, the record of the court proceedings would have been compelling evidence.

I have asked UKBA to assist me with my passport situation since 2004, whether they also failed or could be bothered I don't know. I also supplied them with a letter from the Zimbabwean authorities stating that they couldnt issue me another passport without any form of I.D.

I sometimes dont understand people who say Labor are kind to immigrates, cause the system is against immigrants. It's a system where if you are not mentally strong enough or mature, you couldnt easily end up insane or a criminal.

I dont agree with people to come to this country and commit crime. I wish the leaders could have a week of my life and maybe they will understand how it feels to be skilled and live a life without any form of I.D when you have pressure to provide to your family.

At the end of the day, im prepared to die, my family are my reason for living, i will just kill myself. i strongly feel this way.

I will either remain in this country alive or as ashes with my family, deportation is not an option for both parties, me or ukba.

was this with a south African passport or a zim one. being a Zimbabwean myself, i doubt they were issuing these visas to them at the time.

unfortunately the Zimbabwean authorities are talking about your Zimbabwean id which can only be issued in Zimbabwe not any other id from this country.

i agree with you, coming here to commit a crime is not right, having said this, i think you need to take responsibility for you actions and stop blaming life here. when you first got here you were allowed to work like everybody else and had time to sort your immigration issues, but did not. (you could have got your visa on a paper if you did not have the passport, they do that you know).
there are a lot of illegal immigrates who work not commit crimes to support their families. (i know this is illegal too but at least they are not hurting anyone.)

threatening to kill yourself will not get you anywhere. try and solve your problems like all of us and do not expect the easy way out. i have friends who have been waiting for asylum claims for years and i do not see them complain or doing crimes. besides from the sound of it, you made a life in South Africa that you can always go back to.

i wish you all the luck and hope you get your asylum so that you can support yourself and family.
