Working visa in US with criminal record

Post by chrispen1 » Thu Apr 22, 2010 7:23 pm

I am considering going to the US next winter to work for 6 months, I have an employer set up.

3 years ago I got a criminal record for embezzling £1000.

would I still be able to get a visa? or is there just no chance? I really dont know anything about the visa process.

There pretty much is no chance as it's not a family visa. I suppose theoretically you could fill out an extreme hardship waiver and provide evidence but to be honest the extreme hardship really has to be extreme and most of these get rejected.

The US sucks anyways (I'm from there and I'm staying far away!)
I tell it like it is.

The "hardship waiver" only applies in the context of immigrant visas, in the case of hardship to the US citizen petitioner. OP is not looking to immigrate.

There is a waiver for non-immigrant visas, but it's not clear if the OP really needs one. My advice would be for him bring all details of his conviction during his visa interview, and see what happens.
