Citizenship Application:Need Clarification on Offences

Post by SumitGupta » Sun May 02, 2010 1:39 pm

I recieved ILR on 1st June 2009 and I am eligble for british citizenship application in June .

I have two traffic offence and one Civil Conviction
1)speeding Fixed Penalty in 2007
2)Jumped Red Light in 2010

Civil Conviction:
Breach of Peace 12April 2010 12 Months Bindover

Could you please let me know would these be considered by Minor offences and my application would go through or Would I have problems.

As per guide, the case worker will normally disregard the single conviction for a minor offence resulting in a bind over. I think that if this is the only conviction, you should be alright.

You do not have to declare your traffice offence fixed penalties, as they are not convictions. So basically you can forget about them.

Bind over will usually be disregarded by case worker if your satisfy all other requirements. But please note, they say it will "usually" be disregarded, doesnt mean that they have to disregard it.

But if you apply for naturalisation in April 2011, then your bind over will be spent anyways, and you will have nothing to worry about. You wont even have to declare it.

So if you want to play safe 100 percent then apply on 12 April 2011. :D
