Hi,

I need some clarification on filling in the Set M form, specifically where recourse to public funds is concerned.

I Claim Child Tax Credit, working tax credits and also Child Benefit. I am self employed and my wife (the claimant for ILR) thankfully got a full-time contract which was renewed recently. Just to clarify both me and my wife are on the claim for wtc/ctc. I added her name due to the fact she came to live with me when she entered the UK in July 2008.

My question is with regards to question 7.6 of the Set M form with regards to these benefits. Reading the sticky post it seems to suggest that the benefits I claim do not fall into the 'Public Funds' definition.
6A. for the purpose of these rules, a person (P) is not to be regarded as having (or potentially having) recourse to public funds merely because P is (or will be) reliant in whole or in part on public funds provided to P’s sponsor unless, as a result of P’s presence in the United Kingdom, the sponsor is (or would be) entitled to increased or additional public funds (save where such entitlement to increased or additional public funds is by virtue of P and the sponsor’s joint entitlement to benefits under the regulations referred to in paragraph 6B).

Am I correct in saying I tick NO to 7.6 Are you or your partner receiving any Public funds?

I would just like to clarify this as it's very important that the information I give is accurate. I have read the sticky in the 1st post which is enlightening. My wife has an appointment in Croydon on the 3rd June.
