Tier 1 - Dependent maintenance requirement

Post by dreamer645 » Sat Mar 13, 2010 9:45 pm

Guys,

Just trying to clear my doubt.....or say acting duff....
Below is the maintenance requirement as mentioned in dependent policy......

My question:
As i have been in UK for last 5 years.......and my wife is applying for Tier 1 dependent from India.....she only needs to show 533 pounds......am i correct in assuming that.......as most of you have said, its 533 + 800, but can't understand why i need to show 800 as i already have Tier 1 visa till next year.

" 42. at the same time as his/her spouse and two children. He/she must show that he/she has £1600 for his spouse and a further £1600 for each child, in addition to £800 required for his/her own support. In total the family will require evidence that they hold £5600 in available funds (£1600 x 3 = £4800 + £800).

If the same Tier 1 Migrant and his family had been present in the UK for two years, they would 43. require evidence that they held £2399 (£533 x 3 = £1599 + £800) in available funds.

If a family member applies separately from the Tier 1 Migrant, there must still be enough funds 44. to support each member of the family. Therefore in the example above, if the family has a third child, the main applicant has been in the United Kingdom for two years and the family applies for leave to remain for the third child separately, they must provide evidence that they have an additional £533 in available funds."

Guys thanks in advance...

It has extensively been discussed here. http://www.immigrationboards.com/viewto ... sc&start=0

While many think and the guidance says that the £800 also should be shown, there are some people who oppose it and have a valid reason because they have shown maintenance only for dependant and have successfully got visas. so, it is up to you if you want to go by the policy document or by the words of people who have actually got visas by only showing dependant maintenance. :? :?

In my initial application i missed the maintenace requirement.

Hence submitted during appeal.

I showed 533, but it got rejected as they didn't consider it as original and said it was photocopy. Hence would be making a fresh application soon.

Cheers
