Rejoice Britain! there's a conservative government!! I wonder whether changes and policies advocated by them will somehow affect pending applications for the ILR...

OK finally wait is over but I have been given Discretionary Leave to Remain (i.e. Limited Leave) until 20 April 2013.

I had applied for indefinite leave to remain in the UK on the basis of 14 years long residence on 30 July 2009 and I received a letter yesterday morning (11 May 2010) through my solicitor that I have been granted a discretionary leave until 20 April 2013. I am entitled to work full-time and/or claim DSS benefits. I will qualify for a further extension of my leave to remain in the UK for another 3 years following which I will qualify for indefinite leave.

That means I now need to wait for 6 years more before I can apply for ILR... WHAT AN UNFAIR DECISION HAS BEEN MADE... I will complete 16 years in the UK in November this year and by that time it will be 22 years... GODDD... I cannot bring myself to think I could live without a UK passport.... I will be in my middle/late 30s by that time.... why they giving me ILR after 22 years of long residence.... why not when I turn 70 or 80 just before I die? HUH

I am so distressed. Although, I am now entitled to work full-time in this country but I am worried that 6 years is a long period and there will be new tougher citizenship rules take effect in July 2011. I have every reason to be granted ILR because of my age, when I first arrived in this country (I was only 15); I have no criminal convictions and most importantly the fact that all my family is settled here so I have very strong family ties in the UK.

Is there any kind of adjustment that Home Office can change its decision and grant me ILR? Your kind advice in this regard would be greatly appreciated.

Was that a 8-9 month wait you had for a 14 year application? Good to see that it wasn't the 2-3 year wait that people like to tell 14 year applicants they've got (and there are many ppl who like to do this, openly and via PMs). Best, also, to highlight that in the new thread if you decide to create one. It will be reassuring for those 14 year applicants that linger on this board but are too scared to post.

do you know why you were given a discretionary leave? What was the reasoning behind it?

I can't find any information from the caseworker guide to suggest there is a systems whereny discretionary is given?

I remember discretionary is only given to asylum seekers who don't get refugess status but on compassionary grounds?

Sorry to hear that Procrastinator, but on the plus side atleast you have some kind of legal leave to remain now. I think it may be worth consulting an immigration solicitor as to whether you can change this leave.

on a side note.. I have applied on 10 yr legal stay, and i personally dont have any issues with 14yr applicants posting here.

Someone on the other forum who applied in january based on the 14 year rule already received a decision just a few days ago although it was a rejection. It doesn't seem to follow that a 2-3 year wait is definitely required

I'm sure Procrastinator will be pleased with the support you've given them. But they've left out an important point which will explain the Discretionary Leave rather than the ILR. I will leave it up to Procrastionator to explain what may have pushed UKBA to that decision.

Beige - 2-3 years used to be a very true reflection of the wait ahead for 14 yrs. But this year it appears the UKBA have reduced this drastically, which is good. Behind scenes I get PMs from people too scared to confront me here (on this board) telling me that I should have to wait 2-3 years also should expect bad news. That's why I push this point on here. So I'm not trying to get at anyone on this thread. So if I'm boring anyone with all this that is the reason. You'll have to excuse me until I finally get my point across

Well.. I haven't heard anything back. I called the UKBA on tuesday last week and I was told the standard 'your application is still in process, no decision has been made'. It really is pointless calling

. So I definitely won't be calling that progress line again and I intend to wait until I make the top of the caseworkers queue.

well,another friend of mine received a letter from HO told her the decision has been made on her ILR with all supporting documents today (except her passport),so I assume she got it finally,apparently that's the standard procedure.
Also seems like ppl applied with 10 yrs student visa took longer time than those currently working,so I won't expect mine to come bk in less than 6months.
My friend applied in November last yr (10 yrs student visa),took her 6months,so I guess for people submitted their ILR application with 10yrs student visa and not currently in employment should expect at least 5-7months wait.

welcome to all newbie whos joined this thread. congratulation to those who received your ILR, unfortunately only few ppl on the list received ILR recently.

sorry to taylondon that not granted your ILR.

i have been out for this thread for awhile. i still abroad, been away to UK over 1 month, currently holiday at Australia, Melbourne! try to settle down here couple years, i know is silly doing that since i got UK ILR and not stay there. as we all can see that UK economy really in deep trouble, downturn. sterling currency really not worth anymore.

is anyone know that, if i travel abroad and come back uk nearly two years period, validate my ILR and abroad again, does my ILR still valid right? still eligible to apply citizenship in future?

recently renew passport and stamped at old passport, decided to stay australia now. wondering do i need to transfer stamp to new passport immediately after renew passport? or i can do it after i go back nearly two year?

if you do have these information. please let me know. thanks.

I have not heard anything yet and I am at the very bottom of the list, so hope that January applicants will start hearing news sooner then me.

So, Boonbin - you now decided to stay in Australia? are you Australian or you are working there? I am not sure about the answer to your question. Yes, you can stay maximum 2 years outside of UK but I am not sure if you can stay out longer then that even if you keep comming back here for short stays. Who knows, perhaps you will like it more in Australia after all and won't be bothered with UK after all.

I think that no one knows a correct answer to your question. Rules are not very clear regarding this aspect. For example, they say you should intend to make UK you Permanent home, In addition, Immigration officers are allowed to use discression in their decisions, so I think a lot depends on the immigration officers who will deal with you at the border. The rules say person should not spend long periods of time away from UK (mentioning 2 years and nothing else).

regarding the transfer of stamp to new pasport - you do not need to do it now, you can travel with both passports. Why pay for the transfer? I think you have some other plans on your mind now... so it may be better to deside what you really want to do next and once you will be certain that you want to remain in UK, then do the transfer.

Got a Question for everyone!
I just found out that my solicitor sent only passport, KOL, set(O) form, P60 and cover letter to the HO. IS IT NORMAL? when I asked why they did it that way, they said that HO has all the information in the database anyway and it was a waste of effort to send all the papers to them... (they claim to be former senior caseworkers and reasured me that this is the way HO works) any thoughts about it??

If a person is applying on the basis of 10 year residence, it says on the application form that you only need to send all the passports you've held in the 10 year period and your KOL certificate. Those were the only things I sent and quite a few people on here have done the same

I have some news to share with you...hopefully it will assist somebody in some way or another....

I have aplied for ILR (10 year lawfull residence). Application sent on 19h April 2010, Application received by Home office on the 21st April, money deducted on the 21st April as well. Acknowledgement letter received few days later...

Readng this board as well as others, I have prepared myself foe along wait..at least 6 months as thats what HO say on their web site...

Todau I went to check my post in the postbox..and found a A4 size white envelope...from looking at the return address on theback of the envelope I could tell it was from Home Office....

I also could feel my passport just by touching the envelope as it was quite thin...and the passport size is quite small very easily recognizable by touch size....

Before I opened the envelope I started to be quite nervious as I thought that Home office must have sent a Rejection or Refusal Letter...as it was very eary days...

I opened the envelope and found my passport endoursed with ILR....

ILR was issues by Liverpool office. ILR issued and dated on 10th May 2010 ...so it took 2 weeks an d several days all in all...

I hope my expericence will be of some help to other applicants.....

(As soon as I saw the ILR endoursed on my passport..I called my Mom straight away to share news with her...she was vey happy...and as I was speaking to her...I kept looking for my ILR sticker every now and then trying to believe and trying to read again and again trying to believe that I am actually reading "Indefinite leevae..." and not having some hallusinations....)

Well I have read andlooked at my passport again after few hours and it still says "indefinite....".. so I am not having any hallusintions....

Hope my exprience will be of any help to others who applied under 19 year rule....

Before putting my passport away to a safe place..I just had another look at my ILR sticker on my passport...its just that I was still in a bit of a surprise state myself...so just wanted to have good look at it..also touched the work "idefinite .." a bit...just to make sure it is real....

...after looking at it for good 20 minutes.... it just now finally it sunk in to me that I got the ILR....

hopefully your application is being dealt by Liverpool office as well....I am sure you will get your ILR very soon Zeddie...
