PSW Dependant maintenance question - please help

Post by klauz » Sun May 16, 2010 7:28 pm

Hi,

I already hold a PSW residence permit, living in the UK, and my spouse is now applying as my dependant from overseas.

The UK Border Agency website says:
"If the main applicant under the post-study worker category is outside the United Kingdom or has been in the United Kingdom for less than 12 months, the family member must show that the main applicant or the dependant has at least £1,600 to support the dependant as well as the funds needed to support the main applicant."

So what is the total amount of maintenance she will have to show? £1600 or £1600+£800 or £1600+£2800? I obviously already showed my own maintenance at the time of my own application. Does she need to show maintenance for the main applicant at the time of her application?

Thanks for your help! Really appreciate it.

Sushdmehta, thanks for a very quick reply. In your opinion, can they say that it should be £1600+£2800 based on the fact that if the main applicant applies from overseas then he needs £2800? It's just a bit unclear in the rules.

So it's £1600 for the dependants, but then £800 or £2800 for the main applicant? After all, the dependant is applying from overseas, so £2800 for the main applicant looks like a feasible claim?

Thanks! Really appreciate your help!

Had you been outside UK, then you would have needed 2800 pounds for yourself. But since you are already in UK, you need to show only 800 pounds (for yourself).

Since you have been in the UK for less than 12 months, you need to show 1600 pounds for your dependent. Had you been in UK for more than 12 months, you would have needed only 533 pounds (for dependent).
