Hi All..

I am a newbie and hope that I maybe able to pick your brains regarding this matter. My younger sister and niece came into the UK in 2004 from Zim. We had trouble trying to get their affidavit for legal guardianship for my brother who was still in the army at this point. However, he sent in an application all the same which was subsequently refused due to insufficient evidence.
He has been out of work since he left the army but the children have been here all along. He now has ILR but for reasons unknown to us all he did not put in their application with his when he did it as he is their legal guardian and had now aqquired the affidavit.
I am at my wits end because one of them is already over 18 and the other is soon going to be 18 in a few weeks.. I now have ILR but mine was a legacy case so could not have claimed them as I assumed he would have got the application in by now...so my questions are

- What is the best way forward...is it possible to get some sort of stay for them even though he is not in full time employment. I am currently looking for a job too and am in receipt of JSA. How can I help them..I know the application has a high chance of refusal on initial application but what can I do or can I force him to do because he seems not bothered yet the money for the applications is now there?
