Hi,

I have Tier 1 General. Due to some problem I left the UK three weeks ago and I think that I'll reurtm to UK in 40 days (total absence would be 60 days). If in the next 4 years, my absence would not be more than 120 days, then do you think that there will be any problem in my application for ILR by current laws? Because in that case I will not be absence more than 6 months and not more than a three months for a once.

Please don't make multiple topics on the same subject.

That would depend on the reason of your absence(s). What is of significance is to prove that continuity of residency in the UK is not broken during any absences.

Moreover, you will be affected by the "earned citizenship" changes so ILR, as it is known and assessed under current rules, will not apply to you.

Thank you for your reply and sorry for duplicate post.

I am employed as part time (hourly) in a company and they do not have problem about this absence and I could return to my job after coming back to the UK.

The reason is some business problems in my country (and not the UK).

Then, do you think according to the current rules my absence would make any problem? The "continuity of presence" in the UK is a very general term and I do not know how officers treat it.

I know that ILR will not be applicable to me but it is probable that similar rules apply for probationary citizenship.
