Doubt regarding ILR

My hubby is on WP going to apply for ILR on june 2010, I am in india for past 6 months for my delivery.I cant go to UK now due to some personal reasons.My question is if my hubby got ILR , what will be my visa status.I alreadt spent 4 years in UK on WP dependent visa, Will my clock gets restart after my hubby's ILR.Should me and baby wait for 2 more years to get our ILR.please advice.We got WP dependent visa till dec 2010.Please guide me.

Invalid, because your husband will cease to be a WP migrant.

Yes. You will need to apply for EC as a spouse of settled person (as has been advised to you before). You'll qualify for probationary citizenship as per the new earned citizenship laws - not ILR as it is known today - after completing the residential qualifying period as defined in the new laws.

If you want to apply for ILR (and naturalisation) as it is granted under current immigration laws, then return to UK before your husband applies for ILR and include yourself and child as dependents in his ILR application.

If British citizenship is your aim, my personal suggestion is that you return to UK before your husband applies for ILR.
