complicated psw case

so i start
i came in UK in sep 2008 n was granted leave till jan 2010....i was admitted to city uni.....
since i had a resit in one of the subjects i had to give tht resit on 25th of jan 2010......(most of my friends were given visa till feb 2010)........and my result was gonna come in mid feb 2010....so i had to go back to my home country and apply for PSW...but i didnt want to go....so one of my friend suggested me to apply for another couse via a college which is still listed in ukba a listed colleges and get the student visa extended......and i wanted to study more as well ....so i applied for a course in one of the colleges........so my visa was extended n then after few months would have applied for PSW.....but my student visa extension was rejected in end of march 2010.... reason stated tht i did not tell them that durin the period from sep 2008 to jan 2010 i was doin masters in UK.....so i consulted a lawyer and decided to appeal against the decision......and at the same time is maintainin 2800 pounds in my account ......my appeal date is in first week of aug 2010.....but i have to go back to my home country next week bcoz of my real brothers wedding.......so i wont be able to attend the appeal......n since i have maintained 2800 for past 2 months and will spend around a month in my home country for my brothers wedding it will be 3 months.......
so my main concern is.....when i apply for PSW from my home country will i have to show them the docs about my previous refusal and tell them tht i had an appeal but was not able to attend it.......how should i put my case ahead....i dont know im a bit tensed and have sleepless nights thinking about it that will i get PSW or will they reject it based upon my above case............ bcoz i did not overstay i still have right to remain in UK till aug 2010 till the appeal process........please guys help me out......wht documents will i need......and wht shall i do.....
one more thing as i said i have maintained 2800 from past 2 months in barclays bank....so is it okey if i submit prinout of online bank statements or will i have to submit the original statements......bcoz since im leaving next week ....i wont be able to get the statement for last month .......please guys ....waiting for ur suggestions......thnxxxx

If you indeed hid details of your master's course, then it was a huge mistake and you should be glad that it did not invite a ban (as yet anyway).

is there something called an "unreal brother?".. withdraw your appeal before leaving. you shouldn't worsen your situation more than it already is.. without your presence, your appeal would automatically be rejected or else you could ask your lawyer to attend it on your behalf.. maybe go for a paper appeal..

Of course you would have to tell them about your previous refusal. are you begging to get banned?? and show them that you had filed for an appeal but withdrew it since you had to come home..

u brought this upon yourself if u didn't mention your previous course.. i would suggest barbiturates and advice you that a visa rejection to a foreign country is not the end of the world. You should probably look at the different options in your home country and learn to love it more. Personally between us, I have got rejections twice, but it never gave me sleepless nights. I was just plain angry most of the times..

yeah.. but if your withdraw, u would have to leave the UK as soon as possible..

degree certificate of ur masters, letter proving the date that your degree was granted by the university.. maintenance fund certificates, refusal letter from previous application, appeal documents.. somebody else please correct me if i missed something..

original bank statements only or online statements, signed and sealed by the bank.. set ur friend's mailing address for the bank statements to be delivered and ask your friend to courier it home to you.. he advised you and got u here in the first place..

bcoz since im leaving next week ....i wont be able to get the statement for last month .......please guys ....waiting for ur suggestions......thnxxxx

Your situation is quite simple. You wanted to apply for student visa extension while in UK, got your application rejected and you appealed against the decision.

Due to your brothers marriage you have to leave the country and hence you would like to cancel your appeal and apply for PSW fresh from your home country after the marriage.

I dont see any problem here except maybe the home office can ask why you changed your descision to work instead of studying for which you can give a lot of reasons.

my lawyer said tht once i leave on sunday......he will withdraw the appeal in next week around monday or tuesday so once he withdraws the appeal ill already be in my home country ..............hence i wont be overstayed in this country...........

I guess that should be fine.. keep ur return tickets safe.. u can use it as proof for your date of return..

If you leave the country it is possible that your appeal could be considered to be abandoned, depending on the legislation involved.

Before you leave the country you should check this for sure.

Hi ,

Your case seems to be complicated and with rejection it is amplified . IMO, finish your appeal business here in UK and than go to your country . With all supporting docs apply for Visa. Hope for the best ... but your case is complicated as you hide information ... i see refusal 75% in your case.... but hope for the best
