Can we change start date on certificate of sponsorship

Dear Friends,

My certificate of sponsorship is issued on 20th April 10. The start date on CoS is 21st June 2010. Now, I have got premium appointment date on 26th June 10. Say, I get my ICFN and passport after a week. Then I need to give a month notice to my current employer. That means I will not be able to start with my new company before at least 30th June. In this case,

1. Can we change start date on certificate of sponsorship from 21st June 10 to 30th June 10?

2. Will I be able work for my current employer after 21st June, if we can’t alter the start date on certificate of sponsorship?

Please advise.

As I understand it, certificate of sponsorhip is a live document.

Perhaps, but this would mean cancelling the current (new) CoS and issuing a (another) new one - and therefore delay. Also, your new employer may simply refuse to entertain your request to do so.

Hi sushdmehta,

You are right...the immigration agency my company has hired has denied to alter the certificate of sponsorhip....

However, with regards to your second reply below, they say that I can continue to work for my current employer even after 21st june (start date on CoS for new employer) to serve my notice period and can join the new company say after 30th June.....

Are you aware of any clauses on UKBA site which says that I can not continue to work for my current employer? may be I can show them that.

Thank you very much for your response.

As my new company’s immigration consultant is advising me to continue work with my current employer until I serve my notice period.
1. What can be implications if I follow his advise and work till 30th June with my current employer?
2. Will my current employer be informed by HO that the start date for my new company is 21st June?
3. Will there be any problem when going for extension due to this?

If UKBA states that you can't, then it must be against the rules. Quite possible, Right? Otherwise they wouldn't publish anything of this sort!

What you are querying is whether you can get away with it, which I cannot comment on.

Best to check with UKBA, because if it is (ever) found that you have been in breach of immigration rules during your stay in the UK, you may end up paying a heavy price for your mistake.
